i-102 form with AOS

There are a lot of conflicting solutions to this problem. It sucks that the USCIS do not have specific way of handling this situation.

I also had this sent to me:

"Do you still have the passport and visa you used when you last entered the US? And do you know the date and place of entry? Does your passport have an entry stamp for that date?

If yes to all questions, you can file the I-485 without the I-94 or I-102. Just include a copy of the identifying pages of your passport, and also a copy of the page with the visa you used to enter the US and the page with the entry stamp."

so confused.

Who sent that to you?

Hey there,

OP wrote me in PM so I could help, as I used to be in the same situation, but well almost same situation...

I filed AOS with no I-94 (I was never given one eh...)

At that time, I had an infopass and the USCIS agent recommended me to file without it and to include instead the copy of my stamped visa instead (just as he described).

But my timeline was very different, I just had arrived with a K1 and I guess USCIS could verify easily I entered legally in the US territories.

(You know, why would have I entered the USA not legally as I applied for a K1 a couple of months ago...)

I got a my green card extremely quickly which made me think my application went straight to a supervisor for approval.

Now OP timeline and situation are a little different than mine...

He entered the US territories long time ago and he actually LOST his I-94.

I didn't loose it, I was never given one...

So I'm afraid OP should file for I-102, I remember reading here some people got the remplacement one very quickly, 3 weeks or so...

I suggested OP to make an infopass, now if he already did one and the USCIS agent suggested he does the same as I did, why not, it worked for me.

I remember reading an official USCIS document, addressed to immigration lawyers that stated I-94 can be replaced by : copy of passport (ID part + stamped visa) with a description/timeline of the arrival in the US territories.

For the record, I had also included my boarding pass.

Last significant immigration event:

ROC: Approved : 04/17/2013

USCIS works in mysterious ways...

I am having the same problem, what was your solution friend?

all i did was attach other forms of evidence to prove lawful entry and what not.

So far i haven't had any problems since i filed it.
