Timeline

I just received a request for evidence for my petition to remove conditions. I have no idea what to submit. I have already submitted copies of bank statements showing a joint account, copies of joint credit cards, copies of our insurance policies, and letters from people saying that they know we are legitimately married. Also a copy of a rent agreement we had when we were living in my husband's country. The problem we have is that we don't own anything and the apartment we live in is owned by my parents and there is no formal agreement. I was thinking I could ask my parents to make up a formal rent agreement, but I have no idea what else I could submit. Any help would be greatly appreciated.

I had the great opportunity to have dinner with a director of the VSC Saturday evening. A sit turns out his wife is Russian, came here on a K-1 and is now an aquaintance of Alla. So we had some great conversation. Our next step will be the I-751 and he has worked in his career as an IO who conducted AOS and lifting of conditions interviews and gave me lots of good information on evidence. Here are some things he likes to see and others which are "useless" in his words

Good stuff

Joint bank accounts, joint tax returns, joint ownership of property, cars. Joint leases. Joint insurance. Named as beneficiaries on life insurance and medical insurance. Joint credit cards. Any other joining of financial interests (the theory is that if one is willing to risk your property and money the relationship is more likely valid) Government documents showing common address, drivers lisence, etc. Photos are good, kind of expected, but NOT primary evidence.

Children?

Yes and no. If you just had a child together and the man is nothing more than a sperm donor...no. IF you have children, whether "together" or with a blended family and there is evidence that BOTH participate in the child's development and education, and care that is great! I told him I am listed on all of our son's school papers as parent, I am an emergency contact and I sign all the permission slips, etc. He is covered by my medical insurance. All good stuff. A birth certificate in itself ("Look we have a kid") does not prove a legitmate relationship. It is especially important that the school (an objective 3rd party) recognizes both people as "parents" and accepts this. Medical records for the child showing both people as parents. same reasoning. If a doctor will recognize and treat a child based on their knowledge of both being parents, that is pretty darn good evidence.

Useless or not so useful stuff

Magazine subscriptions together (WHAT??? "Yes, you would be surprised how many couples present a Sports Illustrated subscription as proof") laughing.gif Utilities, cards and letters from relatives, emails, chats etc. Theory? all of these can be easily faked and in themselves prove nothing. Utilities do not verify information before adding someone to an account and hey, it's the electric bill, you are going to pay the electric bill anyway. There is no financial risk involved, no commitment as in joint ownership. Affidavits from friends or family do not have a lot of weight. None of these things are BAD and in conjunction with other evidence are fine, but not enough to prove anything themselves.

Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

Can you send them more bank statements? When we got ours they wanted more of those so I sent them every month from 2 and a half years. lol

We also didn't have a lease or anything so I had my relatives sign and affidavit stating that we don't pay rent or anything and got it notarized.

Have you sent in copies of your drivers licenses/IDs for both of you? Do you have any bills/subscriptions that have your names on it?

The names don't have to be together, just show that you both have things being sent to that address.

I ended up sending in a years worth of cellphone statements and a few medical bills.

Maybe send in some photos. Have you taken any trips? You could copy the ticket stubs and itineraries if you have.

What does the RFE request specifically?

How much did you send them originally? Many people lately have NOT sent 2 years of evidence. You need to send 2 years of evidence not just the last couple months of papers/bills.

Timeline

Strong Evidence is joint tax returns. Did you already send these for each year you have been married? I see you filed in August 2012, so you could send the tax return transcript for 2012 as part of the RFE response.

They aren't just asking for random stuff in the RFE. What did they specifically ask for? A good ROC application would have joint bank statements spanning the course of your residency, copies of joint bills/credit cards spanning your residency, insurance policies, ID's with same addresses, boarding passes for trips for both of you, pictures, joint tax returns for all years of residency, lease/rental agreement/contracts that you made jointly, mail addressed to both of you, statements from people who know you and your relationship, birth certificates of any children together, etc.
