I am using my OPT extension. This year h1b cap reached max limit and my company was not able to apply in proper time. Next year my OPT will expire January 29 2014. So I cannot apply h1b next year with my current OPT.

I will register another master program to maintain my status and then my company will apply h1 on April 1 2014.

My question is that when my h1b is approved , still do I have to attend school or Do I have to wait November 1?

I know my work amortization will star November 1 but maybe I will be legal in US without work authorization until November 1.

Timeline

It is a little hard to understand what anything has to do with November 1st.How can you know that it will start November 1st? There is no way to tell if it gets approved and when.

If you asking about your status during time between H1 petition is filed and approved than no.You do not have to stay in school after I-129 is submitted but if you do not get approved than you can not fall back on your F1 again.
