Hi,

I'm curious as I have immigrated over and I am in AoS procedures, now my spouse needs to see a doctor and currently we are thinking of applying for medical assistance to help as she doesn't earn a huge sum, now I know I cannot apply for benefits due to status but I wondered if anyone had any experience here with spouses applying for benefits.

She is a US citizen and has had assistance before but we don't want to jeopardise my adjustment.

Any help would be grateful.

As long as you meet the income guidelines for Medicaid, there will be absolutely no problem for your wife to apply for Medicaid. Explain your situation to DSS and they will leave you off of the paperwork. It will not affect your immigration status at all.

don't worry it will not jeopardize your AOS...as long that she indicated that ONLY her applying for medical and your refusing to have it.

Medical assistance is purely to help with medical bills, food assistance/stamps/ebt is more widespread you can buy groceries, fuel etc with it where it is accepted

I'm sorry Jen and Mark, that reply was intended for "fight for love".. because I had a very similar question however I am in need of food stamps, but "fight for love" replied to me that I am unable to receive any assistance because my husband is a conditional resident he has his GC now, even though I am born and raised in the States.... ?

You are a USC. You can apply for and receive any benefits that are needed and you qualify for. The foreign spouse is not eligible for public means tested assistance and it should be made clear when applying for anything that your spouse is not eligible and you are not applying for assistance for him, but you as a USC certainly are able and free to apply.

I understand those regulations completely, and they make sense. However, my husband is not applying. I am. Doesn't that make a difference?

to be honest i'm not sure for food stamps. so far as i know if someone in a household apply for those benefits he/she need to include ALL household. not like the medical. perhaps double check with your social worker who will assist u. just to be in safe side. goodluck!!!
