i entered US with k1 visa but we didn't get married with in the 90 days period. we got married after 2 yrs. now we are planning to fix my papers but we dont know what to do.. Hoping that u guys will help us. we need to know what forms do we need and what are the requirements we need to submit.. thank you so much in advance.. God Bless. :)

As long as you married the original K1 petitioner you can file an I130 and I485 and adjust based on the marriage. The K1 no longer applies because you missed the 90 day window. It will show that you entereed the country legally.

This will not be over quickly. You will not enjoy this.

Are you in the USA? You can apply for I-130 right now for IR1 after approval you can pay for visa fee from NVC and inform them you apply I-601A, next you have to apply for I-601A provisional waiver of unlawful presence (beginning 04/03/2013) before you go back your country for interviewing :thumbs: .

You can apply for I-130 right now for IR1 after approval you can pay for visa fee from NVC and inform them you apply I-601A, next you have to apply for I-601A provisional waiver of unlawful presence (beginning 04/03/2013) before you go back your country for interviewing :thumbs: .

That is incorrect. No waiver is needed as the OP is still in the USA, and she will not need to leave the country. In fact, she should take care NOT to leave the country till she has her greencard.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
