Hi,

I need some advice please!! I came here on a k-1 visa married to a U.S. citizen. I was granted a conditional green card for two years. My two years expires August 12, 2013. When I was granted my green card, they put my maiden name on the card. I figured that I would wait until my two years was up before changing my maiden name to my current last name of my spouse. I was reading on the internet that I need to submit I-90 to change my name and have my card replaced for $450.00, which also included the biometrics fee. I submitted the I-90 application and fee a month ago. Immigration sent me a receipt and an appointment for the biometrics to be done on April 30, 2013. Then just today, I get a notice from immigration stating that I need to send an I-751 form to remove conditional status. I understand now that the I-751 is the proper paperwork that immigration needs in my condition. My question now is what will come out of the I-90 form that I sent? Will that form still serve to change my maiden name, or could I have changed it with just the I-751 form? I don't understand why the I-90 form even mentions anything about conditional status if it is not the proper form to send. Do I need to repay the biometrics fee a second time with the I-751 since I already sent the $85.00 fee with the I-90? What about the appointment that I have set for the 30th of this month to have my biometrics taken care of, can they still use that same appointment for the I-751 biometrics? If the I-90 form was useless, is there any way of transferring that fee as a credit to the I-751? Please help as this whole imigration process is very confusing!! Thanks

First things first - I-90 will likely not produce a green card with old or new name. You can expect no refund for that filing or credit towards the I-751 fee - your problem that you didn't check all details first and asked around before sending I-90 in.

You have to submit the I-751 with full fees (biometrics included). Now's the time to put in the married name on the forms so you get the 10-yr green card in the married name.

hi how long did you recieved your Receipt? and did you pay by check? because i send I-90 by mail last week coz i lost my GC and im wondering if they already recieve it coz the check that i sent to them the $450 wasnt deducted yet in my account.. i put a incomplete address via usps express mail but i believe they already figure it out whats the missing no. in the address and i tracked it and it says Delivered.. its been a week now and im still wondering what happend to the check and form that i send to them... thank you

We did a I 90 shortly before filing the I751, still had to pay the fee but they will not generally redo an BIO within a 15 month time line. The check should cash soon. You could have changed the name on the I751 form and list the AKS's.
