I feel so bad for everyone involved in this shocking incident. I also admire how quickly the suspects were found, and very much admire the fact that the second suspect was able to be taken alive. America can really band together and do great things when faced with a disaster.

Here here Man. Screw the suspects. I have no sympathy for the 19 year old man that did this. a 19 year old should know that you can't run around killing people .

My goal in pointing it out was not because I feel any sympathy for the perp (are you kidding?).

The courts don't give a s%$t about victims. They care about the procedures followed during the prosecution. I am hoping that the choice to define him as enemy combatant doesn't come back to bite them in the appeals courts when this is an open and shut murder by terrorism / death penalty case where the perp got caught red-handed and on film.

Why then pursue an untested rule or law and especially on US soil? Do you REALLY believe that the courts will uphold a law, after the appeals run out, that bypasses firmly established principles?

I agree somewhat. If the exact same act had been committed by a natural born citizen who was also a "radicalized Muslim", I think the feds would probably have still treated him as an enemy combatant and denied him miranda rights. I'm not sure this is the right approach in this case. I've heard some talking heads speculate that the feds have plenty of evidence to convict and they don't care if what he says is thrown out. Where will we draw the line in the future against self incrimination? I think that line is being blurred in this case.

Do we even know for sure whether or not he was Mirandized? What I got from media reports last night was that no one knew for sure how his interrogation would be handled...............

See above. That law is untested in the court system and I cannot see the court holding up the conviction if they do not follow due process. They are risking having the WHOLE THING overturned.

It is true that some GOP Senators are stupidly calling for the ####### to be treated as an enemy combatant but I see nothing that suggests that this is what the DOJ actually is doing. In fact, NBC reported that Tsarnaev will be treated as a criminal. The report below outlines the case forward. Terrorism and murder charges are in store. That is the right path. Worked on McVeigh and it will work on this punk all the same.

What does following the rules, crossing the t's and dotting the i's to ensure that someone is properly convicted with no chance of appeal have to do with sympathy? Did someone pass out stupid pills this morning?

I hope they do have all the t's crossed and i's dotted in this case. I would like to think that there was much discussion on how to proceed once he was apprehended.

Not really. There were some that called for him to be treated as an enemy combatant. You'll always have some dumb suggestions but those do not make much of a discussion. What we have here is an American citizen having committed a terrorist act and multiple homicides and hundreds of attempted homicides and, and, and ... in the city of Boston. He will be charged by the feds with federal charges and I am sure the state of Massachusetts is going to take a stab at him as well. He'll be convicted, sentenced to death and executed.
