I will be using a joint sponsor when I adjust status (my dad) but I will be moving to NY right before we get married, and I will probably not be working yet when we send in our AOS package.

Although I have a joint sponsor, I know USCIS can get picky about letting someone totally unemployed sponsor an immigrant, even with a joint sponsor, right?

If so, do you think it would be all right if after I secure employment (presumably soon after filing) I send in proof of employment? So as not to get rejected based on the I-864? Or will they send an RFE for that?

Hehehe am I getting ahead of myself?

My wife was unemployed and well below the poverty line when she sponsored me (she

was a full-time student at the time) but I had a very good co-sponsor (a friend -- $150k

annual income + property worth $500k + 401k and other assets) and it worked out just fine.

You can file the AOS with your non-working I-864 and your Joint Sponsor's.

When your AOS interview finally comes up, you may submit a NEW I-864 for yourself and withdraw the Joint Sponsor's if your new income is sufficient.

I was someone totally unemployed at the time, and they let me sponsor my husband in. ;)

You can not add info into your case after filing, until you have yrru interview.

Wow I had no idea. But I still don't have 3 years of tax returns, only 1 (was in school making less than required to file, then out of the country) so I'll probably still need my dad. But I feel relieved. It also makes my filling out the I-864 pretty easy. :)

The current I-864 requriement is for the one, most recent tax return, not three.

I read that in the instructions but then there are these boxes for "I have attached my three most recent tax returns" or "I have attached one, but I filed three." There is no "nope, just one" box. But I'm not going to be doing this until March or April. I'm just a little ####### about getting everything done as soon as possible.
