I-130 application not at the closest field office

I called the USCIS today to check on my case and they told me that my case was transferred from NBC to Kansas City Field Office. However, I live in Minnesota.

Is this considered to be normal? Or should i call them again to confirm this information???

Thanks!

Some dumb bunny evidently thought Minnesota was Missouri, or mistyped it. Call the USCIS and talk to a Tier 2 and raise hell (nicely).

Yes, you should be concerned about it, because they are not the correct field office for you and your case could be further delayed while they figure it out. Call another Tier 2 rep and verify it tomorrow.

well they gave me this bologna about how they send the file to the field office that has the shortest "processing" time.

How should i approach this subject matter tomorrow? What are some things that i need to learn from them?

That's not something I've heard before. The rules say it is definitely your local field office. If you go to the website, your field office is determined by your address. I would ask if all Minnesota cases are being sent to Missouri, or if yours was a special case. If you can't get a good answer you may need to involve your Congressman's or Senator's office.

if that's the case, that's a good thing, IMO, as a 'first blush' was done at MSC, to see if any RFE or NOID potential stuff in the casefile.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Darnell, the MSC and the Kansas City Field Office are both in Missouri. I think the OP is definitely talking about the field office and not the MSC. Am I missing something?

could you point me to where i could find that the cases are supposed to be sent to local offices?

i'm not trying to argue with you or anything, i just would like to use this information when i call them tomorrow. I feel like i will have more leverage when i clearly show them the rules.

the rep stated that the file was "transferred" to a field office. and they checked another "program" and told me that the file was transferred to Kansas City Filed Office

No, I know you aren't arguing. Here's the announcement http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=c3c7ca7c5fed9310VgnVCM100000082ca60aRCRD&vgnextchannel=e7801c2c9be44210VgnVCM100000082ca60aRCRD

It clearly says the case is to be transferred to the field office with jurisdiction over the petitioner's place of residence. I'm assuming that your case is in fact a standalone I-130.

You might consider asking WHY the case was sent to a different field office, and whether it will affect processing time.

Yes it is just I-130 i did include all the things that you need to complete the I-130 like G325A and things like that.

That's good to know the website and the announcement on their website.

ya, MSC does a first blush then sends off to a field office.

Supposedly it's the local field office, but there's still load balancing stuff going on...

So it's quite possible it's in Kansas City local office.

The OP has called numerous times, got an ISO each time, and the ISO has said the same thing each time, so

surely it's at Kansas City? No ? Yes?

i just wanted to clarify what i said previously. When i said when i asked multiple times, i meant that i asked today's ISO multiple times to make sure I heard that correctly. But this was the first and the only time I called the ISO regarding this situation

ok - plan for more calling, over a weeks' time, i suggest 3 to 4 more telephone calls.

make a note of what's said each time, then take the >40 percent answer.

Good Luck, and Go Get Em !

[if you study my profile, the 'about me' section, you can see what fun I had with ISOs. ]

i will make sure to make couple more phone calls to make sure they have the same answers. Should I be writing down their name and ID?? as well? Something to identify them with or would that not do anything for me?
