leaving for the usa with intent to marry ??????

just a quick question iv always wondered

is it a good idea to go to the usa with the intent to marry your partner lie to customs to get in get married then adjust the status and get a green card through a family based visa

i have heard of the 30/60 thing and obviously the i130 form

what does visa does the i130 form become after processing ???

iv just always wondered if its a safe idea and can people get away with it easy

But um yeah that is illegal and this site does not condone that.

Lying to immigration is never ever a good idea due to possibilities of bans up to and including lifetimes.

It is NEVER OK to lie to immigration.

It is ALWAYS OK to enter the US on a valid visa (or the VWP, if you qualify) to marry, so long as you don't overstay.

It is NOT OK and is very risky to enter with the intention of staying and adjusting status, because it's ILLEGAL. Basically you're lying at entry and saying you don't intend to stay, even though you do intend to stay, and being caught in a lie can mean a permanent ban from the US. It is NOT SAFE and I don't care how many people tell you it is. Some people get away with it, but you don't want to be the person who doesn't.

The I-130 form eventually becomes an immigrant visa, and then a conditional green card valid for 2 years if you were married for less than 2 years when it is issued, or a regular green card valid for ten years if you were married for more than 2 years when it is issued.

I'm a dual US/Hungarian citizen (both by birth; Hungarian citizenship verification TBA), and my husband is a dual British/Irish citizen (by treaty) from Northern Ireland. We are atheists.

28 Jun 2013: POE Houston

08 Jul 2013: SSN received (at SSA office)

07 Aug 2013: Green Card received

27 Feb 2014: Whoa, life happened. Planning move "back home" together to Republic of Ireland by end of April.

29 Apr 2014: POE Dublin through Heathrow

15 May 2014: Received formal residency/work permission (GNIB card with Stamp 4, one year renewable) for the ROI

It is called FRAUD, and you can receive a LIFETIME ban for it! :no:

i - That is considered immigration fraud.

iv - It is not a very safe idea because if you get caught you're deported never to enter the US again.

thats what i thought so tell me what are the chances of getting caught eventually even if you get through your poe ???? like i said above i am not going through that im doing the k1 visa as that is my way to be with the one i love im not taking any risks trust me it was just a simple question i thought like i asking but keep the replies coming in folks

I don't know what the chances are and I doubt there are statistics available.

but dont you have to go through an interview with the i130 with a CO and he says the final word if it was bonafide of visa fraud ????

The interview is only one of the many steps in the process at which they can call you on it.

i thought so so even if you get through your poe you can still get pulled later on for it ???

i have also heard that you can go get married and file for the i130 so it makes you legal to stay there its being processed ????

is this true im guessing its not

and how hard will it be to get through customs even with a return flight for 90 days ?????

so i guess people go there and get married and come home is that a better option ?

IMHO all those questions become immaterial when in the end, the entire idea is to commit immigration fraud. It is not unlike murder. Regardless of whether one gets away with it, it is still a crime.
