I was an F-1 student in Strayer university from 2008-2011. Out of 3 courses of a semester I missed some classes of one course because it was in another city, but I realized too late that they are serious about F1 student laws and i was arrested by the ICE officers in my house.

I was out of jail on bond. I then had court date, lost the case and I opted for Voluntary departure. I left USA September 2011.

Now when I had to pay the bond, i gave up all my saving and I couldn't pay debt of credit-card,DMV fees and some other bill - totals up-to $1500.

At the moment I'm in United Arab emirates and I was allowed to graduate my last semester from UAE. The moment I graduated, the next week the country stopped issuing work visas for bengali nationals where i'm a passport holder and i'm unemployed for a year.

I want to go to US and get a job if possible .applying for multiple visit visas Is it suitable for me to apply for any visa due to the voluntary departure and debts.

It been 1 year 7 months since I have been out of USA. Can I get a Affidavit of support or financial statement support from my uncle living in USA or should it be my fathers if I'm applying for multiple visit or is there any other category I could be eligible for?

Any help would be appreciated.

How long were you considered out of status? If it was more than 180 days you have a three year ban and more than 365 days you have a five year ban. Hard to say exactly when you started being out of status since you were on a student visa.

If you want to work in the US you must have a work visa, you can't go on a tourist visa and work, that is illegal.

It is highly unlikely you will ever obtain a tourist visa due to your prior violations of immigration law, your lack of ties to your home country, and you having relatives living in the US.

Is your father living in the US? Is he an LPR or a citizen? He could possibly file for you to immigrate to the US but the wait is a long time.

The ban does not apply to "out of status". It only applies to "unlawful presence". "Unlawful presence" only starts after the final ruling of the immigration judge in his case. So he doesn't have to worry about the ban.

I think I was out of status for 2 weeks. No I meant I would like to go on a tourist visa and then apply for H1B or find a job. I know its illegal. No I wasn't caught because I was living illegally, I was caught because I missed more than couple classes. No my father dosen't live in US.

What is the type of application i should apply for since I want to go and work there? My country Bangladesh, the state of environmental is very violent and out of order at the moment, people are dying in the streets, people cant come out for work or grocery. In this situation can I apply for political asylum in the US, or that is only possible after entering US.

Try Canada, you have no one to get you into the US legally and most likely they would not grant you asylum because you have resided in other countries after leaving your

birth country, maybe you can try to get to Canada and apply for asylum many Bangladeshis live there and they seem to be a little more lienient on asylums I have heard.

I have 2 of my uncles, mom's brother living in US. My birth country is UAE, and UAE does not provide citizenship or passport since they got independence, lol. Asylum can only be applied after entering the country right? I think asylum takes around 2 years to process right? Does Asylum get you citizenship?

I missed a sentence. I did have ties to my home country, I used to travel to my home country every year for 17 years until I went to US to study.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Are you sure you have told us everything about the voluntary departure? It seems highly unlikely that you were hunted down by ICE and detained simply for missing a couple of classes. Over what period of time was this? Is anything written in your passport?

Asylum isn't suitable for your case.

No I missed more than couple, i think 6 or 8. I got out of status, and I applied for reinstatement and in that time ICE came in and arrested me. I was out of status I think but not sure around 2 weeks, June 2011.In my passport, in the student visa page it is slashed out written void with a ink pen. So in what situation can I apply for Asylum? Back in my home country Bangladesh the situation is out of the norm system, people getting murdered in the streets everyday, can't go out to work or do grocery of any kind etc.

For asylum you have to be in a situation where you are afraid to go home, by travelling there every year you have shown that you aren't afraid to return. Your job search will probably need to be done remotely. After having run afowl of immigration no matter the cause you are not likely to get a visitors visa any time soon.

This will not be over quickly. You will not enjoy this.

Well the violence situation back in my country started 2 months ago and it has been the same everyday. I have traveled back home for validation of visa status in UAE after seven years. So can I apply for I-601 I-212 for petition. Isn't there any scenario same as mine and got back to US. I have 2 uncles in US, one is in real estate and other is married with the wife pregnant. Both are naturalized citizens. Can they help me in any for legally.
