Hi all,

I have an interview coming up at the end of next month for CR-1. As I was reading through Consulate reviews I stumbled across this review from last year.

Was called over to booth 5 and spoke to another lady. She told me to put my four left fingers onto the scanner and she checked them off the computer She had paperwork in front of her. Asked me a few questions such as "Whats the longest time I have spent in the USA", "Have I had any problems with US Immigration". She then passed a form "Refusal Worksheet" to me and said I have been rejected due to the Section 221g guidelines. She explained to me the procedures to rectify this problem. My Petitioning Relative needs to provide a US Federal Tax Return(2011) to the US Consulate so further processing can proceed.

My questions to helpful VJers is -

- Why would this Section 221g been issued at the interview stage and not during it's time at NVC?

- My wife has filed her 2012 taxes. Should I be worried that it may not be processed in time for the interview.

My thoughts are that if NVC has completed my case than there should not be any issues with financials this late in the final stages at Consulate. If anyone has any helpful thoughts on this or similar experiences, it would be very much appreciated!

The NVC does a 'pre-check" on your documents and the I-864, but it is the embassy that approves or denies- ie they can still tell you what you have is not enough. As the tax deadline is now gone, you will need evidence of having filed 2012 taxes.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Seems like your wife didn't file her 2011 taxes, I would check on that. If she hasn't filed for 2011 , you won't get a visa until its completed. Even if she filed 2012 its not enough, all prior income taxes must be current as well. As Penquin said, NVC just gathers the paperwork for the consulate. The consular has the final say whether you've met the requirements needed to issue the visa.

She should submit her IRS transcript for the 2011 taxes if it is available. If she did not file for 2011, she should file now and submit a copy of the entire filing to the embassy, including supporting documents such as the W-2.

She may submit a copy of the entire filing for the 2012 tax year, whether it has been processed or not (you don't have to wait on the IRS).

2011 was more than a year ago. If you also send the 2012 tax forms and they show enough income, you should be OK. If you have also sent in a letter from her employer proving that she is employed and makes enough money, and/or you have sent in her recent pay stubs proving current employment and income, you are OK there too. Make sure you send the letter and/or pay stubs if you haven't already.

ok and what if you file 2012 but u were employed at the end of the year like in september 2012, but u now have documentation showing that your above the 125% poverty line for your household???

Then send the employer letter and pay stubs verifying when you were hired and your yearly income, along with the other things they are asking for.

Thankyou all for helpful information. I have my wife's 2012 Tax transcripts now so hopefully there will not be any issues. Should they be emailed to the Consulate prior to interview to be filed with my other documents, or shall I just take them with me to the interview?
