Welcome to the forum.

Sure, you can certainly withdraw your I-129F K-1 petition (be sure to officially do that with USCIS), get married, and file for a IR-1/CR-1 spousal visa. By doing so, you will start over at the bottom of the spousal visa piles. According to the VJ stats for I-130 adjudications, CSC is currently processing Sept. 30, 2012.

The issue with all of USCIS application/petition processing at this time, is that the service centers have and are continuing to be inundated with the "DACA-tsunami" application processing. This tidal wave has brought application adjudication for anything other than DACA-related applications to a standstill, evidence the virtual halting of all other petition/application approvals. There have been over 469,000 DACA applications received by USCIS between 15 Aug 2012 and 14 March 2013! :wow:

At this time, jumping ship in midstream is likely not a good course of action. However, if someone were to ask me today which visa to go for, I would say get married and file for a spousal visa.

Of course the choice is yours.

We're going to just stick it out with the K-1 process. I don't know if I was MISINFORMED when I called USCIS, but... it's sounding like that was the case (or maybe I misunderstood what I was told--this is all fairly complicated). We got really good advice from the vast majority of posters (when we really needed it) and that is greatly appreciated. It's also been encouraging to see the posts from those who've been approved recently.. again, thank you..

Good luck on a speedy approval! Once you two are approved, the rest goes pretty quickly, so it's smart that you're sticking with the K-1.

Mycka, your fiancé could also fly over to the US to wait it out with you if you think that would be easier for you guys than waiting until the summer when you can fly over to visit him. However, as a heads-up, he needs to have proof of strong ties to his home country if he gets questioned by airport security.

I'm glad you decided to stick with the K1, it'll be faster than switching visa petitions at this point.
