I have a tourist status ACR card. I want to change it to a permanent 13a visa. I have been in the Philippines for over 7 months. I need to go back to the states for a few months. When I come back to the Philippines will I still be able to apply for the 13a or will I have to be here another 6 months? I'm thinking I will be able to get it once I get back but I'm not sure yet. Thanks

Hello, i have a 13a visa as well. You aren't required that i know of to be in the country any length of time. As long as you are married and your wife comes with you to petition you, go ahead and apply. Its a long process but worth it in the end.

10-26-2009 Biometrics Appt. Completed
05-11-2010 Request for Evidence on both the I129F and I130
07-01-2010 Case Transferred to Vermont Service Center
10-20-2011 Contacted Ombudsman
02-07-2012 Case denied after almost 3 years =(
03-07-2012 Appeal Filed!
01-20-2013 Contacted Ombudsman again...
