Timeline

Hello - seen conflicting advise regarding ROC and sending copy of mortgage with both names. I have choosen not to add my husbands name to mortgage due to banks complications having this done. We have several other supporting documentation proving we are married and living as husband and wife. Someone said it is a MUST to have mortage in both names. We plan on filing ROC later this week, please help clear up confusion.

Neither my husband or I own or rent a house so we had no documents like that. Instead we just sent in a letter from relatives with live with stating we do not pay rent and are staying with them.

You could include the mortgage and just explain why he's not on it in a letter.

As long as you can show you co-mingle finances and are living at the same address you shouldn't have any problems.

I can tell you we were approved without RFE (or interview) and the old and new house and mortgage were fully in my name as are all the utilities except the water bill. We moved 75 miles but all the utilities were the same providers so just a change of service address. We had to set up water so asked for both names. We don't even have the same last name so even that bill is goofy with a scramble of names. Neither of us had jobs, so no beneficiary/ insurance things from work. No babies. My theory is these people are pretty good at figuring out who is real and you don't have to have everything on the list. We did have joint bank accounts, tax returns, ownership of cars and their insurance, and driver licenses with the old and new addresses. Oh and a joint cat with both names on the vet bill, in lieu of a child's birth certificate. Hahahaha

I'm sure you have plenty of things that will get you approved.

Hey I would attach a letter stating why u both are not on the mortgage just to clear up things and also send stuff which shows both of u living in that house (copy of drivers license etc).

I sent two sets of driver licenses from old address and new address. Ours is done. My husband is already a USC.

Good point about the letter. I actually typed a statement (not a letter) entitled something like

ITEMS ON YOUR LIST THAT I AM NOT SENDING AND WHY

Then I wrote things like--

Mortgage/Lease: I received written pre-approval for a $XXX thousand mortgage in 15 minutes. Had I included my unemployed, foreign husband with no US credit rating that wouldn't have happened so quickly and we would have lost out on an amazing home.

Spouse as beneficiary: I receive X and Y from my former husband's employer as a surving spouse. I am the dependent beneficiary and can't add anybody.

Children: We are beyond child-bearing years.

Etc.

No single item is a must for ROC. Joint mortgage is an important piece of evidence, but if you don't have it, you don't. That's all there is to it.

My hubby isn't on the mortgage but is on the title. We included a copy of the title showing joint tenancy and survivorship and got approved without an RFE.

It is your complete package, that is looked at. In my cover letter for my documents, I put we both owned separate homes. If you have most of the things a "normal couple" would do as married you should be fine.
