That is what you should do, please, be upfront and honest. They know you're nervous and ashamed of the record. They see it all the time. Let them make the decision. Then you'll know how to proceed after that. Even if they throw an obstacle in your path this time, it is not the end of the line.

cheers again my friend this really helped me like i said it the only thing iv ever done wrong and to me its not a biggie just hope the CO thinks the same and goes ahhhhh it was 7 years ago you havent had any trouble since lol here me hoping hey looks like im in for some trouble though

Don't wprry. Just be honest. Don't think you can outwit them; they are the experts and you aren't, and being caught in a lie could result in a permanent ban. But I don't think things are going to go so badly for you.

I'm a dual US/Hungarian citizen (both by birth; Hungarian citizenship verification TBA), and my husband is a dual British/Irish citizen (by treaty) from Northern Ireland. We are atheists.

No. You didn't willfully misrepresent yourself, and you are being upfront now. Don't worry a bit. If you are asked again, though, you must of course admit it. As a US citizen myself I think it's a complete cockup that you have to go through all that hassle, but you know how they are here... paranoiacs with guns. :P lol...

ha, make it a dram of something I've not had before and I'll buy the next round! :)

If you do run into a snag, though, I recommend you and your sweetie consult an immigration lawyer. It isn't terribly complicated but you don't want to blow your chance at a waiver by accidentally forgetting something. There's a possibility it may never come to that but I can't promise anything. Hang in there, it will all come out right in the end.

Incidentally, according to your timeline you're going for a fiance visa, and we here in the IR-1/CR-1 track are old married people. :) Don't forget to check out the threads for the fiance visas as well!

It is nothing to worry about. They aren't there to quiz you on what you might have put on ESTA. I've been around the London process a long time now, reading people's stories and fears. People have gotten visas with offenses for theft, small amounts of drugs, drunken pub brawls, CIMT (fraud) for switching tax disks on their car, breaking windows, letting the air out of tires....

On for DS-156 there is this question:

Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty or other similar legal action? Have you ever unlawfully distributed or sold a controlled substance(drug), or been a prostitute or procurer for prostitutes?

Yes No

Geez, it sounds awful to have to say yes. But at the interview when asked, you tell your prank story. They say, that's fine. Approved. The interview is an informal chat. No grilling. No hard questions. Everybody is freaked out, then they come out and report "What was I so nervous about? That was easy."

Instread of worrying about all this, go get your shots sorted now. Read this list of thing to come and plan ahead.

I'm in a similar position, just received my Police Certificate today. No Live Trace. "Police Access Request" form ready to be completed. Nervous as anything about this. I was arrested for criminal damage at 17 over 10 years ago, it had just been dropped down in Feb from my record. I hoped for the best, but now I feel intense anxiety over it.

In the same day I received my Notice from London, stress level extreme!

I feel good about saying that it's unlikely that one will be a huge problem. Of course it depends on the circumstances and the degree of the offense and the strength of either the adjudicator's coffee or Xanax that morning, but it's not exactly genocide, either. :)

It was a moment of stupidity, one I hope will not come back to haunt me. I was drunk and damaged some vehicles, one of which turned out to be an off-duty police officer. I was held overnight and interviewed in the morning, admitted guilt and was given a fine and a warning.

I don't know where to find some good info on what exactly I should by filling out in my "Request Form". Any help would be grateful.

Regarding what I'm requesting, I think a Police Report, Incident Log and either "Interview with Officer" or "Request for statement to be written"

Please help.

Why don't you call the police station in question and ask them what they are normally requested to send in such cases? All of what you mention sounds appropriate. Since you were fined and got an official warning, the court may also have records that will be important for you to get, even if you were never physically present in a courtroom.

I contacted the police station in question and they put me through to the Subject Access Service 08456013999. Who said that I did not need to file for any information regarding my arrest (I was 16 not 17). Just fill out a VCU 1 Form (Which I didn't know existed) and state what the incident was and take it to the Interview.

He said "No document or paperwork will be available (or very unlikely to be available) regarding the incident. The Embassy will not require any further evidence as I was a minor."

How have I never head of this or have I just missed something here?
