No need to pay an attorney to tell you what you need to send in for your RFE. In my opinion, don't waste your money. That's what VISA JOURNEY is for ... help without an attorney (I also feel that they can slow your case down ... who is better at making sure everything is done quickly and in a timely matter than yourself?!) If what you have isn't enough, you might get called in for an interview. Send in every piece of info you have from the time you were married up until now, i.e. financial and that shows you have comingled your finances. Also, anything else you have that shows you have comingled your life. THAT is what they are looking for. Life insurance policies = good. Having both of your names on the deed is not a must, in my opinion. Sometimes, it just doesn't work out that way ... just like another poster said above ... wasn't logical for them to refinance at a higher rate just to add her spouse. There are definitely other proofs that you live together, and have a good faith marriage.

i thought life insurance, 401 k, car loan are enough for to prove finances join, as for share residence, i thought the anddress on our driver lience is the same which show that we live together. ( i was wrong)

Well who knows! I submitted a bunch of stuff, but it's just as likely they'll RFE us for something. Maybe I didn't send ENOUGH checking account statements, or maybe I didn't submit enough photos....you just never know with them. It's ridiculous.

This is making me worried (argh!), because we basically sent the same stuff to them. I might get an RFE, too :( Grrrr.

You might not. You never know with these things. I have seen plp get green card by providing very limited proof. But just to prepare, I would suggest you guys start gathering as much stuff as u can starting today. That way if you get RFE, u will be ready.

I'm sorry but I have to disagree on the bold text. We tried this ourselves. The house deed is under my name and it goes hand in hand with the mortgage. We asked the lawyer to change the deed, but then they said that it won't happen until the lender changes the mortgage, as well. We TRIED to put my husband's name in the house deed, but due to his financial adventures in the past, the mortgage rate just changed significantly, and unfortunately not to our benefit.

So we decided to leave the deed and the mortgage be in my name, instead of suffering from the financial implications of such change.

This could only be with our lender :X Other lenders might make this easier.

On topic:

Sorry, why can't you add your name to his account or his name on yours? I'm having a hard time understanding it :( If you have disagreements in financial management, it doesn't have to actually be implemented in the accounts. You could still keep your separate accounts and do your personal financial transactions separately? I mean, I chip in to pay for the utility bills, but I shop using my personal account, tee hee ;)

I remember a year ago I asked my bank about the deed and they said I can add my husband's name anytime to the deed. Not to the loan but to the deed. They are two different things. so to put someone on the loan, u need to refinance but to add to the deed u don't need to. I dont know, maybe ur bank is just being difficult.

I know :( I've also seen people provided much less proof than what bearstory has and yet got approved, just like that. I thought retirement plans, car loan, shared health insurance would be strong points. I mean, you would only share health insurances with a family. It's a monthly payment, after all. And car loans are not really cheap :|

It's so hard to analyze these things. Sometimes I feel it's so random. If I get an RFE, I'd definitely ask for help on here :(

I was actually soo surprised when the bank told us that. We already paid the lawyer because they already did the paperwork for the deed change. Then when we asked the bank, they said, the name(s) on the deed MUST match the mortgage. I was like, "You're kidding me?!"

I got the mail today I received my RFE. I was kind of surprise because I put everything that I would think should be in the file...

So my question here is do you think it change something if me and my husband are renting his parents house without any real lease paper? I ask his mother to write us a letter saying that we are staying in their house and making payments...

Is it enough or they would like to see the real paper work? We are building a house right now and send them all our house project information as well...

Did you send an affidavit from his mother stating that you rent from them with your initial I-751 paperwork? If not, then yes, I would include it with the RFE if they are asking for more proof of marriage and living together.

When you say an affidavit do you mean a letter? My mother in law wrote a letter saying that we were renting her house since 2009 and we were paying 600$ a month. Is it consider an affidavit?

No can do. You would have to refinance.

Yes, basically. They also sell rental agreement documents at places like Office Depot. You could get those and have her work up an actual rental contract. Not sure exactly what they want from you without knowing what they are asking for and what you already sent.

They didn't ask anything specific, they only put a list of all the evidence possible to give them. I send them everything other than evidence of a credit card together and pictures.

I'll add this and add more letter I guess.

We were renting my parents in law's house since 2009 but last September 2012 we stop renting it and start living on our property while we are building our house. I hope this won't bother them.

I read on here before we did our ROC that there were three things USCIS especially wanted. Joint mortgage/lease, joint tax returns, and joint bank account. Sometimes you can't get one of those things, but you only had one of them.

Life insurance etc doesn't actually show someone that you trust them with money. You don't deal with that insurance every day, and you can't get money from it.

A DL with the same address doesn't count for much. My husband and I could get DL's at my parent's house in a state we don't live in, because we can show a piece of mail sent to us there (that's all they need for proof of address). It's not hard to get a DL at a different address than the one you sleep at at night.

But, there is no sense in beating yourself up about it. What done is done. Just send back some more things (you never answered about another year of taxes) and call it a day.

Any discussion about what a good ROC should look like is for others who have yet to do it.
