Update:

She has set an appointment with the Infopass for submitting the withdrawal letter. Does she needs to mail the same withdrawal letter to USCIS where she submitted the petition? Also she worries that her husband will find out about the withdrawal and she fears for her own safety. They have signed up the online automatic notification notice. Anyone out there have advice on this? If she don't withdraw now and if she did not go for the interview, will her husband has the right to appeal?

Tell her to stay at a friend's and get a restraining order against her husband immediately after the infopass. The infopass should take care of all the withdrawal information or they can advise her on what to do. Tell her to not go anywhere with him.

If reported to ICE, is to deport him?

Ice has been primarily focusing on illegal immigrants who are committing criminal offences. Even if he is here without legal status, ICE won't chase him down. There are an estimated 12 million illegal immigrants in the USA. Chasing down every case is impossible, they don't have the resources. Until a case is made before a judge, and a judge orders him removed, don't expect them to do much. And even then, it might not happen unless he happens to fall across their path by accident.

She should just worry about her own self, get restraining order etc. if she's worried about her safety, withdraw the petition so she has no obligations, and get a divorce. Beyond that, whether the guy leaves or not or whether the government removes him or not is not really her business.

Once the I-864 is withdrawn, he has no further basis for filing an adjustment of status casefile with this particular human as the sponser.

Tong Yan: You're asking more questions than helping her. By the time you are done asking, they will get their NOA and biometircs appointment. Just follow what people said, and don't care about if he gets to know it or not. If she has no friends the town, I think that should be her smallest issue right now. Just cancel the procedure as others said, leave him immediately and just move somewhere else, or get temp jobs in the city. If she has some saved up money, she could use that to move back to wherever she came from....

If you'd like - you can tell your friend

that

once inside the USCIS Local Office, ask for the ICE Shift Supervisor,

and then once she has the ICE Shift Supervisor in front of her -

show:

1. withdrawal of I-864 letter

2. cover letter stating she is filing for divorce based on infidelity in marriage

3. all the proof she's gathered up

then ask for a receipt number.

That's about all she can do, really, and to be honest, it's a #######-shoot if it will have any effect on any 'future filings' or no.

When she's finished with the ICE Shift Supervisor, give another letter of I-864 withdrawal to the human behind the glass. It's a different section, different department, and it never hurts to get it in twice, once in the building.
