Yes, will take action ASAP. Will make appt. on Infopass. On Infopass what type of appt. should we choose? Thanks.

Whichever one has appointments - case status processing usually but you can also pick others or even attempt to do a walk-in.

Tongyan: You need to stop asking more and more questions...people simply told you what your friend can do. Two options namely. 1. Cancel the check 2. make an infopass and withdraw the I-864 form.

The guy paid the check, so that's no longer an option. You don't know what the I-864 form is but that is not important for YOU to know, your friend needs to know who filed AOS for her husband. Come on, tell her to do it ASAP! The more she delays it the harder to cancel the process...

She wanted the real truth.. ! Before making the decision.

Your friend is a bit weird...but go ahead, collect whatever she wants. She'll end up like many others....when she won't be able to do anything anymore...if this makes her feel good, let her dig for evidences...I don't think she knows what she is risking right now....she'll regret, but by that time her husband will be laughing in his hand at her...

While I understand that your friend is going through what must be a very difficult time right now and doesn't want to make what might be the wrong decision, I do agree with everyone else that she should withdraw the I-864 now if there's even a little bit of doubt in her mind about her husband's intentions.

If her suspicions are correct and she doesn't pull the I-864 in time, she could be on the hook financially for a very very long time.

They can always re-file at a later date if everything works out, but she can't withdraw her I-864 after it's been approved.

Update:

She has set an appointment with the Infopass for submitting the withdrawal letter. Does she needs to mail the same withdrawal letter to USCIS where she submitted the petition? Also she worries that her husband will find out about the withdrawal and she fears for her own safety. They have signed up the online automatic notification notice. Anyone out there have advice on this? If she don't withdraw now and if she did not go for the interview, will her husband has the right to appeal?

Thanks.

If he came on a K-1 visa there is a good chance there will be no interview. They will approve the application and mail the green card. Once the green card is produced there is no way for her to back out of the affidavit of support, she will be on the hook for him for 10 years at least (unless he abandons his green card). She needs to stop waiting and deal with this a month ago.
