Hi,

My friend recently submitted all the documents for Adjustment of Status for her husband, however, she found out that he has been cheating on her and realised that he married her for immigration purpose. My friend wanted to withdraw the petition but do not know how. Can someone out there input any information on how to do it. (The documents mailed out last week). Thanks.

The others are correct, cancel the check, send a letter to USCIS. I would also make a infopass appointment and give them a letter in person, along with any proof she has.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Cancel the check! If that fails immediately write to USCIS withdrawing the I-184 I-864 and also make an infopass appointment taking a notarized letter withdrawing the I-184.

Make info pass appointment and cancel all forms send certified letter to where you mailed paperwork return recipt requested and take letter to local office:)

The check bought by him. Telling him might afraid get hurt.

She doesn't have to tell him anything. Simply go in person to Infopass (book it online at uscis.gov), bring the paper saying you're withdrawing I-864 and that's it.

Very true. However, the OP makes is appear that time is of the essence. The OP needs to get going on the cancellation process NOW! !!!

OP, your friend doesn't need proof. She just needs to withdraw the I864 that she originally signed. She can do that anytime before a decision has been made and while AOS is pending.

Send a letter to USCIS, put a copy of your NOA1 in there along with a signed letter that you're withdrawing the I864 based on seeking divorce and thereby your sponsorship. Make an infopass appointment also and bring the same thing as you sent to USCIS.

From there, you can only wait. I'd suggest checking case status once in a while on the USCIS webpage to see if it updates, and to what.

If she wished to, she can include proof of the fraud. And send it to ICE. But it is most important to withdraw the I864. She can always send proof of fraud afterwards,

Haven't receive the NOA. Should wait for the NOA before proceeding the withdrawal?

No! Cancel the check!!! :bonk:

What part of that don't you understand?

You call the bank, and say you want to cancel the check. The back puts a "stop payment" on the check. The package you send will be rejected because there was no money. Then you don't waste your money AND don;t have to deal with this immigration nonsense for a scammer. Don't you want that money back?? :bonk: If you want for the NOA then you lose all that money.

Ahh, well then follow the instructions to make infopass and withdraw the I-864.
