Hey guys, it's me again.

I'm reading the guidelines on the USCIS site and it says we can file the I-485 and I (the U.S. citizen) needs to file an I-130 petition for alien relative? But on the guidelines here I haven't read anything on that? We only have 3 weeks until his K1 expires so pllleeeeaaasssseee your help would be sooo appreciated :(

Your fiance's K-1 visa expired the moment he step foot in the US. It is a one-way one-time visa. Is your fiance's I-94 still valid? You need to provide more information so that people can give you the best advice. :time: It helps everyone that uses the forum.

If the I-94 is still valid, you should file K-1 AOS as soon as possible.

For more information check out the K-1 AOS Guide:

1. if married within 90 days of POE date, I-130 not required.

2. if filing 2 years after POE date (or marriage date), I-130 is required.

Is no reg, no 9FAM entry, on WHEN to file for AOS after marriage, for a K-1 visa holder.

Is REG for when to get married.

Many people file 4 to 12 months after marriage date, no problem there.

What are you thinking? where you get your information? I worry about it, it seems to have got you in a convoluted state.

Is most likely you're reading the instructions for adjustment of status from prior work, prior tourist, or prior student visa .

Yer reading in the wrong place, on the USCIS website.

We've a Guide, A&B has linked it, please read it - as it'll be yer bible for this next round o paperwork filing.
