okay guys we finally got our RFE. so far i thought i made enough income for 3 to sponsor my husband AOS. but i guess i was wrong :bonk:

for some reason they didn't acknowledge my child support income, after we included all the proof (such as court order/recent statement)

anyhow i find a solution not sure if it will works.

my dad he has a business i could start a partime w/him until this AOS is over. (i don't want to ask anyone to co-sponsor..don't want to be hustle to anyone period lol)

will they consider that? if so how can i fill up the I-864 and include this parttime? i have 87days to answer my RFE..how many wks or month of paystubs do i need to include before replying to my RFE?

any help please. thanks in advance!!! :thumbs:

The instructions (page 7) indicate child support can be counted. Are you sure the RFE isn't because you didn't document the child support?

You may also provide pay stub(s) showing your income for the previous six months. If your claimed income includes alimony,
child support
. dividend or interest income, or income from any other source, you may also include evidence of that income.

If they suggest 6 months of pay stubs, then I would think they also would like 6 month's proof that you received child support. I don't know if you get a monthly deposit statement or the particulars, but even showing it deposited with 6+ months of bank statements might be sufficient.

Can you type the exact wording in your RFE that says we do not accept child support as income or did you just interpret it meant that?

Remember I asked did you meet income guidelines without including your child support??? That was the only red flag that I saw. They do not consider that as income because it is not consistent. Even if you have a court order. Many people that I have talked to stated that they got a RFE for child support. It maybe that they did not provide enough proof that it was every month with 6 months or more of statements of payment.

If you work for your father, then you will need an employment letter of start date, status, and salary. Also, you will need all the checkstubs from that job to turn in.

yes i did provide all the necessary document even the last 3yrs of my child support list payment (this documents are coming directly from the child support agency)

so i'm not sure why USCIS not honoring it =(

this what exactly in that RFE

**based on the documents submitted with form I-864, affidavit of support, for petitioner/sponsor, the income did not meet 125% (100%) of te federal poverty line for the petitioner/sponsor's household size.

i don't understand why? even i made more than enough for 3 household.

i'm planning to call them and or even make appointment (infopass).

The longer it takes to happen the more you'll appreciate it when it does!

What did you document the other income with? Did you do a tax transcript and employer letter?

my W2, tax return for 2012, tax transcript for 2011 and 2010, employer letter. but still :crying:

i call the USCIS...it just a waste of time talking to one lol (seems that they just re-read my RFE to me. but no answer lol)

also, i was trying to make infopass online but no appointment available in my area :blink::wacko:

This bolded part is incorrect. See what Nich-Nick posted above from the instructions. Child support can and is indeed counted/considered as income. You must provide a court order and check stubs or bank statements showing that you actually receive the amount listed on the court order. They may not consider it if the child is getting near the age when they will legally emancipate and child support will no longer be received by the custodial parent. However, if the child support is for a younger child and it will continue for years still, you have the court order and documentation of the amount you receive each month, then yes, it is considered since it is income.

uuuggggg why they are sending me RFE? :crying: why me?

i did provide the necessary documents to proof that income.

today i ask my employer to increase my salary. he said he will think about it first lol

if he agreed, that will be extra income for us. hopefully USCIS will consider it.

plus, i'm having hardtime to get an infopass :protest::ranting::girlwerewolf2xn:

i called the USCIS. this guys that i speak with told me just click everything and it doesn't matter what type of infopass. just to make sure i got in and get an appointment. the ONLY avaialble space is...if your a military...i'm like hhhhmmm...and get scare and cancel the appointment. what if they question me later why i choose that and i might get introuble lol

anyone ever tried getting infopass and had this problem? thanks

i too included child support when i filed for my husbands K-1 visa and it was accepted...i sent the court order for it and 3 years of past bank statements showing it being deposited directly. I recieved no RFE's and his petition was approved and visa issued. I hope everything works out for you.

oh men lucky u :thumbs: how long ago was this? hmmmm i should probably inlude my bank statement for the last yrs. i will try that also. thanks for the idea :thumbs:

Maybe you counted your household size wrong?? A lot of people make that mistake.

So on page 3, part 5- #21 what does it look like?

It should say

a. 1

b.1

d.1

h. 3

Line 23 should show your income.

Your income total on that line should include all your income (your pay and your child support)

Does your form look like that?

but the good news we finally got an appointmnt thru infopass. hopefully they could help me and my husband. thanks guys!!!
