Hello everybody,

So I am almoost ready to file for AOS (i came to the USA on a K1) and there is a few questions on the forms that i need help with, firstly on the I-864, i have just one financial sponsor and my original petitioner (my wife). Im probably just being dumb but for part 1 would the correct box to tick be D ?

Ok, now the other stuff im kinda stuck on, G325a. Do i have an A number now that i have an I-94 or is that something that i wont get until my GC ?

Sorry if these are silly questions, thanks for any help you can offer in advance :)

your wife the petitioner/sponsor..the one need to answer and sign this form not the beneficiary :thumbs:

you can able to find your A# at your I-94.

You can find your A# on the notice of approval of your i-129F (NOA2), in the "Beneficiary" field.

At POE they also hand-wrote mine on the back of my i-94.

Maybe i have misunderstood what you have said, I am aware its not me who needs to complete this form, I and my fiancial sponsor were unsure about that one section, the rest of the form was filled out by the financial sponsor (not my wife), Sorry if i have an awkward way of wording things haha

The US citizen and the financial sponsor have to fill out the I-864. Think of it as your I-134 for AOS.

Your wife does her I-864 and checks 1 a . It is required of her as is her tax return or a reason why she was not required to file taxes.

Your financial sponsor does his own I-864 and checks 1 d. A tax return is required.

Don't forget he must prove he is a US citizen or permanent resident. Include a photocopy of the proof with the form.

You totally just cleared all of that up for me, Will just a W2 do for them both or do i need a full tax return transcript ?

All sponsors must submit the following documentation with their I-864:

  • Proof of current employment or self employment

  • A photocopy or an Internal Revenue Service-issued transcript of a photocopy or an Internal Revenue Service-issued transcript of your complete Federal income tax return for your most recent tax year, or an explanation if it is not submitted. Your W-2s and/or 1099 forms may also be required, see the I-864 instructions for details

You may also, at your option, submit a photocopy or an Internal Revenue Service-issued transcript of your complete Federal income tax returns for your second and third most recent tax years if you believe these additional tax returns may help you establish the ability to maintain your household income at the governing threshold set forth in Form I-864P, Poverty Guidelines

A W2 is not a tax return. You will get an RFE if you only send that.

A W2 is not a tax return. You will get an RFE if you only send that.

The transcripts are easy to get, free, and are really neat. I highly suggest.
