Hello all,

I need someone to please guide me through the right steps. I will be a U.S. citizen by end of May 2013 hopefully. Now, I have my parents and younger brother (16 years old) waiting to immigrate from India. They currently have valid visit visa until 2018. I was told to apply for parents first through I-130. Can I do that right after I get my passport while they are still in India? How does the adjustment of status come into play? I am really confused please help!!! I was thinking of filing I-130 for parents...have them come here for biometrics...then have them again for interview...thats like 2-3 trips within 6 months! Please help! What is the safest fastest way for me to get my parents and younger brother to immigrate to the US of A?

You don't have to wait until you get a passport to sent the I-130. All you need is the naturalization certificate, and you'll mail a copy of it, as well as your birth certificate (original + translation), along with the I-130 application and the fee.

Adjustment of status is if they are already in the US. You can check what the current fees are, but when I was applying for my mom, adjustment of status was going to be much more expensive than applying in the home country.

They don't have to travel back and forth. Actually, they may not be admitted into the country on visitor visa if they are in the process of applying for immigrant visa.

You send I-130, and wait few months till that's approved. Then it's another 2-3 months of you sending your Affidavit of Support and IV packet (DS-230) with all the supporting documents to NVC. DS-230 is really for your parents to send with list of civil documents, but you can opt to act as their agent (once I-130 is approved you send DS-3032 form), and they just need to send all those documents to you.

If you study the guides section, you can follow the steps for IR1/CR1 visa; the steps are pretty much the same.

Once NVC gets all those documents, they assign an interview date for your parents in India, they then do medical, in India, and at the interview get their visa.

This process takes about 9-11 months, assuming you are not stuck at USCIS for more than 5-6 months.

You can apply for your parents the moment you are sworn in a US citizen. You need to start with the I-130 and the associate paperwork - check out link below - and your parents will be contacted in India to proceed with the paperwork they need to present on their side. The process is done in India. They will not need to come stateside for interviews. As the result of their process they will enter the US as residents, which means there is no AOS for them. Once they arrive here they will receive have their greencards on hand and they will not need to do anything else in terms of 'adjustment'.

The current waiting time for sibling filing is 10+ years. He will have a shorter waiting period if the parents file for him after they they receive their green card especially if he is still under 21 by the time they get their card. You will have to do this as soon as possible so that he does not age out when the parents apply for him and end up with a longer wait.

Petitioner LPR upgraded to USC June 22, 2012
August 22, 2012: case complete
October 18, 2012: Interview (APPROVED)
October 26, 2012: Picked up visa from DHL (delay caused by Sandy)
December 15, 2012: POE Atlanta....................became USC July 2016!!!!

Mothers' Journey (My sister is the petitioner)

September 10, 2013: Sent I-130 (UPS next day service)

September 12, 2013: Received text to confirm delivery

September 16, 2013: Received NOA 1

March 22, 2014: Received NOA 2

April 8, 2014: File Received by NVC

May 26, 2015: Interview (approved)..........now LPR (delays caused by 2 RFE)
