Hi, I arrived US for 2 months on a K-1 visa. Now I'm going to start my AOS. My husband's income should already reached 125% of the poverty but for safety sake we want to let his mom and step-father to be joint sponsors. They are both retired and we are all living together. Now my problem is that my husband should fill in 864, and his mother fill in 864 and stepfather fill in 864A or should we take his mother and step father as household and my husband fill in 864 and his mother and step father each fill in one 864A.

I would have your husband fill out the I-864, his mother fill out her own I-864 and the step dad fill out an I-864A as a household member of the mother.

Hi, thank you so much for replying. That's the same as what I thought. But someone said we can take his mom and step dad as household since we are living together and add their income. We made a appointment with the immigration officer tomorrow so we'll confirm with him.

You could do it that way and combine all the incomes. It needs to be enough for the entire combined household size that way. It is easier to keep track of the household count if your husband fills out his I-864 and just counts his own household size plus you and his mother fills out her own separate I-864 with her husband as her household member. They would only need enough income for their own household size plus you. So, if they have no other dependents, a household size of 3 is all their combined income would need to be in order to qualify for joint sponsorship. If your husband has no other dependents, then his household count is just 2, you and him.

Thank you. We're going to take his step-dad and mom as household members and have them fill in 864A respectively. According to the instruction of I-864 we have to submit "proof of their residency in your household and relationship",we can submit the driver licences of them to prove the same residency but how can we prove my husband's relationship with his mom and step-dad? Do you have any ideas? Thanks again.

His birth certificate lists her as his mother, and a copy of the marriage certificate for his mom and her husband shows that is his step dad.
