Hi,

Sorry if question already asked.

A mom is a permanent resident (green card holder), can she file I-130 for her children and spouse? Or she had to be a US Citizen to file I-130 for both her spouse and children?

1/09/2009 NOA1 Petitioner received
4/30/2009 NOA2 Petitioner received (approved in 105 days from NOA1 3.5months)

6/20/2009 Packet 4 Petitioner received, mail everything from above forms & I-134 plus other doc as required for beneficiary
7/23/2009 Interview @ 7am, Interview passed- visa pick up July 31st

The spouse you can do at any time children it depends on their age and marital ststus

Sorry, should have give more details,

child are under 18yrs and single. What is the average from start to finish if everything run smoothly? 2.5yrs for unmarried child? and less than a yr for spouse? or they both same time?

spouse / unmarried children under 21 has the same processing time - 2.5 yrs

2nd) What if the child turn over 21 during the process and assume they are still single?

3rd) What if the child is over 21 unmarried, can she still bring them over while she's holding a GC?

No, she only needs to be a USC to bring married kids, siblings and parents.

2) They may have their age locked in- depends on when the I-130 gets approved.

3) Depends on the country they are from- assuming not Mexico or Philippines, the wait for unmarried kids over 21 of greencard holders is just over 8 years. If the Mother becomes a US citizen during the process, she can upgrade the petition and shorten the wait a year to just under 7 years: http://travel.state.gov/visa/bulletin/bulletin_5927.html

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
