I noticed on the step by step checklist for I-485 and I-130 that if you are filing the I-485 there is no extra fee to file the I-765 temporary work authorization. Is this correct?

Word ford on the visa journey step by step checklist for filing inside US it says, in step 1-

"1. Payment as required by USCIS. Be sure to include the payment for both the I-485 and the biometrics fee*. Use a money order so you can track the payment. If a personal check is allowed, use that instead.

>> The fee for I-485 applications filed on or after July 30th 2007 inlcudes the cost of the I-131 and I-765 (no need to pay for them if filed with or while your I-485 application is pending adjudication -- as long as you paid the "new" rate for the I-485 effective July 30th 2007)."

Correct. If you send your I-765 along with your I-485, the fee for the I-765 is waived.

The I-765 instructions are pretty complicated. My wife is filing an I-765 with the I-485.(I'm a US citizen, we got married while she was on a VWP.) I chose C-9 for the eligibility category, filled in like this- © (9) ( ). Is this correct? Also, since we are filing with an I-485, do we need any additional documentation or photos for the I-765,or just the filled out form? Thanks in advance

You must submit all required evidence for each form separately, even if you are submitting them together.

The I-765 requires passport photographs and a copy of a photo ID document (passport, foreign visa, driver's licence, etc.), for example.

The instructions for form I-765 are pretty confusing, there seems to be different documentation requirements depending on what classification you are.

Is their a checklist available for filing this form along with an I-485? So two passport photos are required along with a passport copy? If I understand you correctly, we should include 2 copies of the same passport in the I-485 package? Anything else?

Much thanks for taking the time to help, very much appreciated.

I found this info at immigrationdirect.com-

There are a few supporting documents you need to submit while filing your Form I-765, Employment Authorization Document (EAD) application to the USCIS

A copy of Form I-94 Departure Record. If you are filing the application under the© (9) classification, you need not submit the I-94 record.

A copy of your previously held EAD. If you did not have an EAD earlier, you are required to submit a copy of a government issued identity document. This can include a passport that has your picture, name, and date of birth on it, a birth certificate with photo ID, proof of any visa issued by a foreign consulate; or a National ID that has your photo and/or fingerprint. Remember the identity document photocopy must clearly show your facial features and also have the biographical information.

Submit two similar color photographs of yourself taken within 30 days of the filing your application. Refer to the USCIS photo specifications before filing. Lightly write your name and ARN on the back of the photo with a pencil.

Should you need to show economic necessity, submit a list of your assets, income and expenses
