We cannot get a straight answer on criminal record cert!!

USCIS says that the beneficiary needs to get her police certificates from any place she has lived for more than a 6 month period of time (as of course we all know)

Her hometown and Hukou is near Nanyang, Henan. She will be able to get it there (along with her single status and birth certificate) without much of a problem...or so we hope.

She now lives and works in Zhengzhou, Henan and has been for 2 years. HOWEVER, she technically has no residency in Zhengzhou and therefore has no way to prove to the police station that she currently lives in Zhengzhou, resulting in them unable to give us a certificate of no criminal record.

Also (this is the dilemma we face), on the initial K-1 application form that I applied for back in August (8 months wait now, yayy), I wrote her current address is in Zhengzhou...so I am assuming the embassy is going to want to see her record from Zhengzhou as well since they know she lives there. But we can't get it!

So, 2 questions:

1.) Do we NEED to get both cities (her hometown and the city she lives in now) to give us a certificate of no criminal record, or just her hometown, registered hukou area, is sufficient enough?

2.) Will the certificates of Birth, Marriageability, and Criminal records that she will obtain in her hometown HAVE to be taken to her hometown notary office, 公证处, to get the white books (which we believe they have never done any foreign documents before bc its a very very small town)...OR...can she take those certs to the city of Zhengzhou (both in Henan province) at their notary office 公证处 to get the white books and notarized???

SORRY I WROTE SO MUCH!

ANY HELP YOU CAN GIVE WILL BE GREATLY APPRECIATED!!

Yes

Yes. It should be taken to a city for notary that is part of her village. eg analogy, Essexville is administered by Bay City in Michigan.

Birth certificates are obtained from her parents and then take to notary.

Marriageability are obtain from the marriage office and then take to notary. They give you two mini-booklets - one for your wife and one for you, and there is a wording difference between the two mini-booklets.

Criminal records can only be only obtain in her hometown and is given only 1 document per a year. Then take to notary.

...OR...can she take those certs to the city of Zhengzhou (both in Henan province) at their notary office 公证处 to get the white books and notarized???

Just take it to the city that administer her village. notary office are NOT FUN! expect to spend half-day or full-day there. it will take a average of two-weeks for your notary document. if there are issues, they will call you and it may take up to a month.

I disagree with unlocking sky. As long as you get the police certificate from the city of her Hokou, that is all you would need. It is common in China to live in a city different than the Hokou and I have never heard of getting multiple reports. my wife only got one.

In an attempt to clarify (and not add to the confusion :P ), please refer to the latest K Visa instructions from the Immigrant Visa Section (IV Unit) of the Guangzhou US consulate:

The folks at the Guangzhou IV unit should be able to give you a "straight answer." You should consider posting your inquiry via email with the IV Unit:

BTW: The Guangzhou US consulate is a foreign service post of the US Department of State, not the Department of Homeland Security (or its USCIS agency).

USCIS not want criminal records, when chasing a K-1.

DoS, otoh, does, into Guangzhou IV . No worries there , this is a normal and standard thing.

One Hukuo book, ONE Police Clearance certificate, one white book .

That's it, really.

re: the other 2 docs , birth certificate and certificate of single status - yup - all done in hukuo city (the chinese versions) but the white book may be gotten in the district, anywhere in the district, of her hukuo city. This is useful if her hukuo city is some rural area, but the capital city of the district issues the white books.

As to getting the white books in other province - I suggest against it, not do it - as is easier to get it done in the district where these things were created.

Finally, if it is a problem for her because of time away from work - any family member who has her listed in their hukuo book, can take their hukuo book in and get this done, yer lass not need to travel at all.

Thanks to everyone for you replies and help!

From what we know now, she only needs the one police cert from her hometown. Then get the notary from the district of her hometown, which is in Nanyang, Henan for all 3 documents (single, police, birth).

So I guess that's what we will have to do! Hopefully it will work out.

time to contact your congressman and senators for help!

Already did, over a month ago. Senators were no help, but congressman has contacted them (well, their worker). And they basically just told me the same thigns I already knew, which is how long it will be to wait. So I asked to use their influential powers and try to help me push my papers ahead. About 4 days ago they said CSC will contact me within 45 days. SO HELPFUL

I also emailed immigration, and of course what do I get back but a nice email saying how they "understand" my situation and that I am in the correct time frame. MORE HELPFUL!

I am in the correct time frame.

Yeah, I learned from dealing with immigration (practically all my life), you have to be patient. If you are within the "target" time frame for processing of your case, they will not be in a hurry to get it done any sooner.
