If you are only a green card holder you can't apply for a fiance visa, that is only allowed for US citizens. If you got your green card through marriage then you need to read the I130 instructions about who may NOT use the form as there are restrictions on applying for a new spouse if you got here through marriage based green card.

This will not be over quickly. You will not enjoy this.

Why are you posting in the spousal visa forum? What papers are you talking about? Are you in the process of removing the conditions on your conditional green card?

I get it.

You came on a K-1 and then got AOS and the 2-year greencard. Then you got divorced and now are engaged again.

For the ten year card you will need a waiver from the USCIS. The info is on the ROC form.

The USCIS only care if the first marriage was real or not. Your new circumstances are of no interest to them.

Someone can help you more with the waiver. But you will need evidence that the first marriage was real.

Thank you! I read the form but I couldn't see the part that tells me what I need if I renew with a waiver. It's only saying about the evidence of bonafide marriage. I have our phone, electric and water, car insurance but I don't have a card the card of theh ealth insurance cuz he took all of it when we filed for divorce and didn't get time to photocopy it but I have my medical record thou from his provider. I already asked people to write me a sworn affidavit and I also have his medical record he got admitted to asylum cuz he wanted to kill himself and his mean emails! Our taxes being filed together.. that's all I have!

Thank you and I appreciate it

Since your divorce is finalized, you are required to remove conditions now and not wait for the 90 days. The likelihood of you completing the ROC process by October is slim, and I think re-marrying before you have your 10 year GC is probably inadvisable.

Your finance' has nothing to do with your ROC. Hopefully you have handled this appropriately with USCIS to get this far, check out Herp Derp who ROC'd with divorce.

In Arizona its hot hot hot.
