Husband worked in guam in 2011 and stayed with me in the Philippines from april til october, started a small business under my name, and went back to the US and got a job just recently. So what to do with the AOS on cases like this? Tax on 2011 looks ok but 2012 is not coz he stayed with me most of those times. Will there be problem on the AOS filing? Thanks again.

Does he currently have a job that meets or exceeds the guideline? If so then you should be fine NVC is more concerned about current employment and salary.

i dont know whether the current job "meets or exceeds the guideline"...do you have a link to read more about the salary guidelines for petitioners? thank you

try to find I-864P on the USCIS forms. That's your guideline :D

Just for example... hubs made under the amount last year (2012) BUT only worked 4 months. However his CURRENT annual salary is more than enough so we sent pay stubs that show his annual salary and hourly wage. Because of who is employer is, we didn't bother with a letter from his employer.

Funny thing! Hubs spent 4 years in Guam! Small world. Well it's a small island. LOL

wow...small world.

Guam is a nice place and a lot of jobs opportunity but we weren't able to start the visa journey while he was at guam.

The reason why he worked there is because its nearer in my country, the Philippines.

But now, the journey began and we are hopeful souls for the visa success.

is the guidelines meant for a month only or a year?

try to find I-864P on the USCIS forms. That's your guideline :D
