Hello everyone

I am an American citizen married to a filipina with 3 kids, we traveled to hong kong no problem and re entered the Philippines so that I got my 1 year free stay.

Now we want to go to the USA to visit for a few weeks or so.

can my wife gain exit clearence to go with me to the USA? and if so how long can she stay?

I am sure you can get exit clearance, but does she have a US tourist visa? If not, she needs to get one before travelling.

I would boudt it, that the U.S. embassy will give here a tourist visa, she would have to demonstrate ties to the Philippines a reason to come back to there. (land, great job, family etc.) assumming you will take the kids with you the chances are 0% that wife and kids would get tourist visas. without the kids some of a chance.

The embassy would look at it as you have a CR-1 application and you are tired of waiting so trying to go on a toursit visa and stay there that way. No matter what your intentions are the U.S. has to look it as she will be staying in the U.S. and not going back to the Philippines. The Philippines has so many overstays, (TNT's) that is why they look at it this way.

Philippine citizens does not need exit clearance unless ordered by court. It's coming to US that someone will need a visa such as tourist visa.

The applicant(s) needs to show strong ties to the home country e.g. high paying jobs, properties or business to prove that applicant(s) has no reason to stay in the US and has the compelling reason to return.
