Divorced and engaged under Conditional GC

Hello everyone!

I really need an advice here. My divorce went through this month . It was a stressful marriage ended up to separation. Now I finally found the love of my life who knows how to respect a woman and we are engaged. We can't get married yet cuz I have to wait for 6 months according to state law. Now my concern is my GC expires on the 12 of December 2013. Should I just wait till we get married or should I apply now to be on the safe side? Thank you so much and I do appreciate your advice!

Hi There!

Do you have your permanent 10 year green card?

If so - Check out the I-130 instructions under who may file and how.

You must be a US citizen to file for a fiance visa, so this is not an option at this time.

Looks like you wait until you can get married.

As your title mentions conditional GC, I assume that means you are on a conditional GC right now? If so, you should file for Removal of Conditions immediately after divorce. As you are filing on your own after divorce, you don't need to wait for 2 years. And since you are divorced, they can cancel your GC so it makes sense to apply for ROC as soon as possible.
