I petitioning my husband and he has a son out of wedlock . We are on the process of submitting ds 230 part 1 , and i realized i made a mistake when i filed I130 question#17 list of children , i mis understood it i just put our children only . But its only now that i noticed it while doing the ds230part1 #29 list of children . We want to correct my mistake by including my step son in the list of his children . And to inluded letter and my stepson birthcertificate to Ds230 part 1 & 2 together with other document to NVC . I want to hear your opinion or if you guys had the same experience .

Sir chief,

We all make mistakes sometimes when completing forms. I believe that it's not too late to include your husband' son. However, you are not petitioning your stepson. If your husband (beneficiary) is granted a visa to come to the USA, he will be coming alone without his son. Once he is here, he will now have to file a petition as permanent resident bringing family members to the USA. This is what he has to do for your stepson to join him here. So, you don't have to send your stepson birth certs to the NVC, but you can only write a separate statement explaining the situation when sending the DS230.

- 02/07/13: RFE Letter was mailed to me this date, requesting proof of father/son relationship. (Unfortunately, I DID NOT RECEIVE A RFE LETTER)

- 03/28/13: Received NOID (Notice of Intent to Deny)

- 04/02/13: Made appointment to speak with the IO at my local office.
- 04/03/13: APPROVED (NOA2 mailed)

- 04/12/13: NVC recvd file
- 04/22/13: NVC Case no.& IIN Assigned

- 04/26/13: AOS Bill Invoced & Paid /AOS Package Sent / DS-3032 Email-Format sent

Is the child immigrating too? Has a petition been filed for that child?

Sir chief,

Thank you , colins ... :) , yes im just petitioning my husband , im just worried that this thing will affect my petition . Anyway my stepson is only 14 years old i still have enough time to petition him .

Is the child immigrating too? Has a petition been filed for that child?

Hi , Apple .. Actually not yet , im just petitioning my husband . But i dont want this mistake will a problem again once we petition my stepson .

No problem! If you don't want to wait for your husband to petition your stepson, you can start the process of petitioning him yourself as stepmother.
