Moving from Canada to US

Hello everyone.

My wife who is American moved up to Canada after we got married and she became PR. My question is if/when we decide that it is time to move to the US, in her case back to the US. My questions how would this work? Would she have to go back to the US and work an extended period of time before she sponsors me or is there another path for me to join her?

If she’s not working in the US you will need a co-sponsor or assets to show you won’t be a public burden.

I’ve heard that the Montréal Consulate is strict for proving domicile. The is a thread pinned to the top of the Canada forum to show you what that’s about and how to go about proving domicile.

There are Guides to show you what you will need to file etc that are on the Blue bar at the top of the page. Ignore DCF as it isn’t an option in Canada as we do not have a USCIS International Office.

There is a lot of reading to do to wrap your head around the whole process. So read up and research other threads and come back and ask questions when you have them.

Please keep in mind that the process is not a quick one. I think 8-10 months is average for Canadian spouses.

I assume it would be best for her to go back to the USA in advance and work before sponsoring me. She would live in Chicago, so it wouldn't be a burden considering it is only 1.5hr flight from Toronto.

I understand. Anything to do with either government will always be long.

If you don’t have the option of a joint sponsor and that sort of thing it may be best for her to move and establish herself there. So much depends on your individual circumstances. I haven’t read much about the domicile process as it wasn’t something I needed for our process.

If you go with her moving back and traveling back and forth, then I would highly recommend getting a NEXUS card for both of you. It simplifies travel a lot. Can be applied for on-line and only costs $50 each. https://goes-app.cbp.dhs.gov/main/goes

VJ is a little slower on the weekend so one of the more knowledgable members might be along shortly to give you a better idea of requirements.
