I have a question:

What does "represent a violation of current federal law based on timely filing order." specifically refer to?

And of course I already signed it.

Good luck in this petition. may this be successful now. the one that my fiance created only got less than a hundred.

That is a great presentation, the best I've seen so far. Just needs to be polished up with graphics to gab attention and a few other minor changes. Good job to whomever did it.

Did you know that Craig Ferguson of the "Late Late Show" went through this process aswell? He is from Scotland, and now proud to be an American. We need to reach out. It is true, we are a very small minority. This attitude of what doesn't affect me, is not the American way. We watch out for our neighbors, that's what makes us who we are. :D

I still think taking this to the press is the only solution.

Done.

Not even close Lisa  There's no reason this process can't be done in a timely manner. I think the goal should be 3 months for each center, not collectively either. But this is a baby step to something better for all.

current federal guidelines are to process these petitions within 5 months, also to process petitions in the "order that they were received"

the only legal exception is if one is a member of the Armed Forces and this is by statute. By processing petitions out of sequence they are discriminating and hence in violation of there administrative rules. It is documented here that some November and December petitions have received their NOA2's while those who filed in late July, August, September, and October are still waiting.

All i pray for is legal and administrative relief, and that going forward all I129F petitions be processed no later than 5 months from the date of submission.

Oh, believe me, they are processing Nov-Dec petitions en masse, in fact, I believe they will pretty much finish up this block in a month, unless they slow down the rate at which they are currently processing them. That is clear from the approvals and RFE's on their website.

So since they are clearly violating this, is it merely a "guideline" or is it a "law" that they are violating?

Not an attorney so I can only give my opinion, but Administrative Rules are in place for adjudicating these petitions. Perhaps there are attorney's here that can better clarify this.

If they maintained a strict in order file you would have to wait until every RFE and name check ahead of you cleared before your own petition could proceed. You really don't want what you are asking for with that one. There was once a user Sara and her petition took years to get through CSC. No one would want to have to wait because they filed after that. Petition processing has it's slow times and it's fast times. There isn't enough people going through it at any one point to get the mass of signatures needed for a white house petition. It has been tried several times.

This will not be over quickly. You will not enjoy this.

I am sure many have tried the White House Open Petitions however we are currently experiencing Historic slowdowns in the processing of I129F petitions. CSC is currently padding it's statistics by processing petitions filed in November and December and ignoring earlier filed petitions. I personally have written and received responses back from my Senator and Congressman. I believe that by looking at the volumes of views on some of the posts that this is an achievable process. I personally have posted this thread on numerous other immigration blogs and forums; also on Obama's facebook, Mark Zuckenberg's facebook.

There is a tremendous possibility that if enough people spread the word that this could hit the news media and then perhaps it will become actionable. If someone is in RFE status then they understandably have to wait longer and timely filing becomes a mute issue. Still those in RFE status should be processed once they meet the criteria requested.

All we can do is try, after all "we the people" are supposed to be heard.

God Bless and take care

Please think with positive thoughts. Why can everyone hope for their NOA2 in 102 days. Surly someone with some pull monitors White House Petitions. Maybe it will be seen by the AP The Associated Press 1,414,291 followers.
