I worked in Kuwait 19 years ago, my Fiance filed for Fiancee Visa K1 129F and we all know that one of the required documents is the country clearance where we worked before and getting those from Middle East is impossible, is there anyone who have the same problem as mine can enlighten me? Do we really need the Clearance to present it to US Embassy? Anybody is welcome to share their experience whose Visa been approved without the Clearance, please do share I appreciate it.

This link should explain it to you. It says on the Department of State website that police certificates are available only to those residing in Kuwait. So possibly they will not even ask you for it, but if they do you can explain that even DOS acknowledges it is not possible for you to obtain from Kuwait, having not resided there for 19 years.

So who worked in Kuwait? USC or Filipina?

No one cares if the USC worked in Kuwait.

If the Filipina worked in Kuwait then (in theory) a police clearance is required, except she can't get one from Kuwait and the embassy knows this so they waive that requirement.

If the beneficiary worked in Kuwait, then forget about getting a Kuwait police clearance, you cannot get it, and the US Embassy will NOT ask for it. My fiancé was in that boat. It took a long time to find out for sure that we didn't need it. Even talking to the US Embassy the first time, some a'hole told me 'you absolutely must have it'. We were almost ready to try and fly to Kuwait to get it, that's how stressed. I had asked THREE lawyers here, all said i would need it (See, never hire a lawyer in this process, they're all idiots anyway). Anyway, eventually reached someone in the Embassy who knew what they were talking about.

If that link shows that you must be a residence in that country, then you will not be required.

We DID however have to have it for Thailand.

Police Records

Available only to those residing in Kuwait; certificates are not available for applicants applying outside Kuwait.

It's unavailable, meaning USEM will not ask for it during the interview. Print the page and take it with her. Show it to the CO if asked.
