Good day! I am a green card holder and I have my visa for 2 years already. I gave birth before I got my visa and while waiting for my visa my boyfriend, which is my son's father, we didn't ger married cause I need to be single so I can be approved for my visa. I filed my son for immigrant visa last year and the checked the status for my son and it is almost there. But me and my boyfriend is not still getting married until September this year but my concern is my son. I don't have someone to watch over my son if he gets approved. And I am going to file my boyfriend when we get married this year but it will take long. So my question is, what is the best thing to do to get my boyfriend here? Cause I need him to take care of our son but filing him with immigrant visa will take him so long and I don't know if the embassy is going to allow him to travel as tourist while he is filed as immigrant since I need someone to watch my son. Please comply to this post. I really need ideas.

Your son will be issued an immigrant visa ahead of your BF. The child can travel to the US but if you don't have anyone to look after him, you can take him back to your home country. After you receive your son's green card, apply for a RE-ENTRY PERMIT for him so he can fly back and stay for 2 YEARS in your home country without losing LPR status.

Your son must return to the US before the 2-year re-entry permit expires.

It is almost impossible for your BF/husband to apply for a tourist visa once you already file i-130 for him. But he can still try.

Or you can cancel your son's petition, file i-130 for your husband, son will become your husband's derivative in his F2A petition. They will immigrate at the same time. Waiting time for them is 2 and a half YEARS.

If you have no-one here to take care of your son, why did you file for a visa for him? You can delay his visa some by taking your time sending back the forms necessary, or look into in-home daycares here in the USA, they tend to be cheap.

There is no way to get your boyfriend/ husband here early to look after the son.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
