i just noticed that the latest Affadavit of Support form has the household size that only includes the

Immigrant and US Citizens (marriage based AOS)

while on the older versions of this form HouseHold size used to include,

Immigrant, US citizen and relatives living in the house based on marriage.

I live with my sister so my wife moving in means that my household size for this form is now 2 , whereas according to the previous version it would have been 3.

March 11- mailed out AOS to chicago

March 31- I-485 touched.

April 3- got letter in mail saying Initial interview on May 15.

interview came way too fast..

approved 2 yr card on july 2007

Feb10 - mailed out I-751 to CSC

Feb20 - did biometrics

waiting waiting waiting for the 10 year card......................................

How Do I Count Household Size?

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ affidavit of support whom you are still obligated to support. If necessary to meet the income requirements to be a sponsor, you may include additional relatives (adult children, parents, or siblings) as part of your household size as long as

they have the same principle residence as you and promise to use their income and resources in support of the intending immigrant(s).

So if sister was living with him and was under 21, he could and may claim her as a dependent, note household size is determined by counting people dependent on the sponsor, that the sponsor claimed on taxes, + the sponsored immigrants. If there is a person or persons living in the home that do not depend on the sponsor, and are not claimed by the sponsor on their taxes then they don't get counted on the I-864, example siblings, and parents don't get counted as dependents, and don't get counted as part of the sponsor's "Household" with regards to the I-864, and I-134 forms, to determine what is 125% poverty line.

You're correct. It's welcome change for many people, the previous rule really was tough to rationalize if the co-habiting relatives are not dependent on each other.

Making it even better, you can still count your sister as a Household Member if your income comes up short and she's willing to contribute. It's the Household that has to meet the income requirement, so both the Sponsor and the Household Member can be short as long as combined they are adequate. In contrast, a Joint Sponsor (with their own Household) must meet the full requirement in their own.
