At this point, i feel that USCIS just doesnt give a ####### about American citizens...their priority is giving amnesty to illegal immigrants...screw the citizens. I am so fed up! I am an april filer...I would be surprised if I got a NOA2 by next summer at this rate. It looks so grim! And all the k1 approvals flying out...ranting33va.gif I wish just one Congressman would really bring this issue forward...but its never going to happen. We dont matter unfortunately...can you tell I am not in a good mood? grrrr!

Total process 14 months :(

I like and agree to ur thinking.

It's best to think worst so we are prepared if it takes that long.

But if I get good news ealry I ll take it

Is K-3 really not an option any more? I see plenty of info about it on the USCIS site, so why is that no one does it? I mean I know its a hassle because its short term and it seems like it contains a lot of fine print, but if the wait time is shorter than applying for this........

Someone just mentioned waiting 2-3yrs above and I can't even IMAGINE having to wait that long. I don't want to think it would take that long, but if it gets to 1.5yrs waiting, I think I will look at the K3 option.

My husband actually said that he would be willing to pay an extra $5000 if he could speed up the process and be with me.

We are married but it doesn't seem like it... I hate visiting.

We have no choice but to sit and wait. and they know it. I have zero faith in the USCIS because I heard of TWO cases in my town where the people married just for a greencard and they were approved with no problem. They didn't have any pictures to prove an ongoing relationship... I could go on but you guys get the picture. I even heard that the illegal girlfriend of the guy who married for a GC was blabbing all over that it was only for papers and she was going to amrry him when he finally divorces the american so she can be legal too... She actually set it up for him.. it makes me sick.. UGHHH

I wonder...... When the new Overland Park office actually starts processing how fast they will be able to hammer out I-130's..... in theory if they hired all those new employees I would imagine they could go through them very fast... So in my mind (to keep me from getting annoyed) I imagine even with all of the back logged petitions they will be able to catch up if hundreds of workers are processing them full-time.

Im a CR-1 filer from abroad, so I know it was faster....this past spring, but now with the months of backlogged petitions thats all out the window. We've been a bit depressed lately about the whole situation but maybe........just maybe we will all get a nice surprise when the new office starts processing smile.png

The statement is something like "when the NVC gets both at the same time they cancel the K3". I think all I-129f get processed the same (faster), just VJ is not set up to track the K3's If someone would post the USCIS policy about returning the I-129f and the I-130 to the back of the pile it would let people make up their minds about what to do. Otherwise its like they are joined together but maybe not when sent to NVC? or two different things?

originally the K-3 was created because the I-130 took a very long time. The K-3 allowed the couple to wait together in the US. A bit after 2009, they were being processed faster so the K-3 and I-130 were meeting. Since the K-3 requires adjustment once you get to the US, they just cancel the K-3 and proceed with the I-130 since that one is an instant GC.

I did K-3 in 2009... It is much faster at the NVC (less than 2 weeks) and I remember the I-130 being approved about 2 months later. My K-3 took 10 months back then. When I started getting the requests for paying the fees for the I-130, I was told just to ignore them since I was going with the K-3. I was also told if the K-3 was denied, I could still go after the I-130... However, I didn't need either one of them since I withdrew the petition after all that.

I agree, if you go to the USCIS official site the K3 is still a valid visa to pursue. I also think that it sounds ridiculous to say that if you file a K3 your I-130 gets pulled and put at the bottom of the pile. I personally think thats a rumor that has spread here on VJ as well as other places. Can anyone link something official stating that? Personally after doing my research I filed for the K3 as well as the I-130. Even if it does end up costing me more money and paperwork in the long run I dont care. My goal is like everyone else, to be with my spouse ASAP. Even though the waiting does suck I can at least say that I pursued every avenue I could visa wise to get her here with me. My goal is like everyone else, to be with my spouse ASAP. Even though the waiting does suck I can at least say that I pursued every avenue I could visa wise to get her here with me. It would be great if you keep us updated on how the K-3/I-130 work out for you....Maybe I was just too hopeful going into the process and didn't want to create the back-up plan of the K-3? At the time it just seemed like more money....but given how much we are spending visiting and so on and so forth, I can now see the cost really would not be any worse than travel costs to see each other over a longer period of time.

Timeline

It would be great if you keep us updated on how the K-3/I-130 work out for you....Maybe I was just too hopeful going into the process and didn't want to create the back-up plan of the K-3? At the time it just seemed like more money....but given how much we are spending visiting and so on and so forth, I can now see the cost really would not be any worse than travel costs to see each other over a longer period of time.

My timeline is updated but I will be sure to post any changes as well. We already have an alien number assigned as well.I figured the K3 was worth it. In the long run if that does get approved before the I130 it will mean spending a little more cash and extra paperwork. But to me whichever way works faster is what Im cool with. Hopefully we will start seeing approvals at the end of this month or sometime next month. Sooner the better!
