Just got off the phone with a tier 2. He says there is no specific timeframe as to when my petition filed April 03 (in 4 days my petition would have been 5 months with NBC) will be adjudicated. He put a service request for NBC inquiring about my petition; then tell me I may or may not hear from NBC. If NBC ever replies, then it would be no later than September 14.

USCIS is a joke - a government agency that is unable to maintain accurate and consitent information upon customer request. If by Sep 14, I don't hear from NBC, I will initiate an inquiry about my petition through my US Senator's office. I will once again initiate another inquiry through my US House of Rep, 7 days after initiating one with the US Senator. I will keep on until something happens with my petition.

It's unbelievable how NBC functions. There's no reason to keep petitions piling on their desks or wherever they may be exceeding the USCIS 5 months processing goal.

I refuse to wait and watch my petition exceed 6 months mark.

While privately owned businesses are mandated to be accountable, keep records, improve quality and reduce waste, government agencies on the other hand are very arrogant, incompetent with every other thing under their watch excluding collecting fees and taxes. I can't imagine USCIS collecting all the fees, but not able to build a system to account for all processes they are handling.

I'm not sure what it takes for them to create an account as establish a functional timeline for all locations included NBC, then updating them regularly to show real-time data hmmm!!.

Very frustrating indeed, but we all shal come out stronger than them. Try every possible means but don't let the frustration cause you heart attack. It's well fellow.....we are on the same boat.

I can not find the 5 month proccessing time for the I-130 at the NBC. Please tell me where you see that.

I received this from my congressman's office today. The NBC responded to their inquiry.

After a review of our systems it was found that Case MSC---------, Form I-130 filed on behalf of Ahmed Darwish is currently pending. We process cases in the order in which they are received. However, due to the nature of your request, this case has been given to the I-130 expedite team for further review and adjudication. Once this case is reviewed and a decision has been made, you will be notified.

So even a congressman can't get a time frame out of them. September 23 will be our 5 month mark. I will be on their butts if we reach that point.

Who said a lawsuit could not be filed? We entered into a contract with USCIS and fulfilled our duties under the terms of that contract and expect them to fulfill their obligations in a TIMELY manner. Of course considering how slow the judicial system is perhaps our children would see an outcome of this litigation.. Was it not Janet Napolitano, who stated approximately 8 months ago, that the Department of Homeland Security did not want to separate families? If it ain't s..t it is not coming out of a politician's mouth!

Thank you, I get a server error trying to look at that site.

But from what you have said 9.5 months? Average ? Plus the time with the NVC and then the getting of the Visa in her country. Could be 14-16 months total? They say that the K3 is dead and that it was only used when it took 1.5 to 2 years. I filed for the K3 2 months after the I-130 so now its making me nuts to think I just delayed the whole thing by 2 months.

Had the USCIS just been reporting truly a family would know how to make the right pick to start with.
