Something needs to be done. This wait time is ridiculous.

Btw. Need info.

When I file my taxes next year. Can I file as married? Even if my wife is in overseas.

If I file as married less tax gets taken

Any one has more info on this.

You would have to apply for TIN number (W-7) with IRS for your non-immigrant spouse. Once you get this number you would be eligible to file married filing jointly.

It sounds awful, but I do kind of resent the K1 filers! I wish I was joking, but I'm pretty bitter about this whole process now. Part of me wishes me and hubby held off our wedding and filed K1 now instead, but coulda shoulda woulda....

Genuine question - Do we think that we'll actually get NOA2 by Christmas?!?!

01.27.2014 - Received case no. & IIN

02.07.2014 - Completed & submitted DS-261 form online

02.13.2014 - Paid AOS bill

02.18.2014 - AOS showing as 'paid'

03.18.2014 - Invoiced for IV bill (finally!)

03.19.2014 - Made payment for IV bill

03.21.2014 - IV bill showing PAID

03.24.2014 - Completed DS-260 online

03.29.2014 - Mailed IV Packet

04.26.2014 - IV packet all approved, false checklist from NVC for AOS packet

I have a good feeling about the next few months...but honestly, at this point I don't think anyone knows. USCIS is not helpful, peoples' lawyers say 6 months but there are people waiting who filed in January who still haven't received an NOA2. But, March filers have been getting approved so we should be next in line. I sure hope so at least unsure.png

I'm with you on wondering if we should have just done the K-1 route. But everything happens for a reason right? At least once our husband's have visa in hand and get here they will be permanent residents with the ability to work right away.

05/31/13 - Second trip to Egypt and actual honeymoon in Sharm El Sheikh (left Egypt 06/29)
08/15/13 - Called USCIS for expedite request.
08/16/13 - Sent emails to both state senators and mailed a letter to state congressman.
08/21/13 - Call from congressman that letter is being forwarded to a different congressman. Mailed letters and evidence of situation in Egypt to senators
08/27/13 - Was told the congressman's office would make an inquiry about our expedite.
08/29/13 - Received e-mail that my congressman's office had filed their own expedite on our behalf on Tuesday and would notify me when they hear anything from the NBC.
08/30/13 - NBC responded to congressional inquiry. Could not give a date of predicted approval, but our inquiry was handed over to the expedite team for review and a decision.
09/04/13 - EXPEDITE APPROVED!

hi everyone' am from nigeria ,me and my wife got married in 14th Feb 2013 and fill i130 in 4th of April and got our responses of NOA1 in 8th of April, we 're still waiting for NOA 2.I must confess we 're very anxious to get our i130 Approved, as anyone got NOA 2 for April fillers?

My hubby actually is the USC, it's me that is heading over there smile.png My job finishes in March next year (I'm a contractor) and I had really hoped that when it finished I'd be jumping on a plane with visa in hand...! I can still dream right? wink.png

I'm lucky that my boss knows too, so I can be more open about it all and get help where it's needed. My other milestone is that it's my 30th in June next year and I WILL be in America by then. I will.I will.I will!!!

Yes, you can apply anytime but try to be logical. You have until April 14th, 2014 to file for 2013 taxes so if you think your spouse wouldn't be here and won't be able to get SSN by that time then file W-7 now and get the TIN number. Getting TIN number now and then getting SSN later wouldn't hurt.

Here is what I would do: File W-7, get TIN number, if your spouse is here and got the SSN before you file taxes then use the SSN during filing otherwise use the TIN.

Hi,

In general you have to file the W-7 application for the ITIN at the same time you file your federal tax return. However, if you can document certain exceptions you are allowed to file at any time. Please see:
