Good evening all

I just got off the phone with Tier 2 and thought I would share with you some of the details that the agent gave me. If you are residing overseas with your spouse and will reside overseas until the visa is approved, your I-130 will NOT be transferred from the NBC for processing. Additionally, USCIS has the policy that I-797's will not be sent to foreign addresses, or at least that is the policy. In my case, I received one but not the other, and per the agent that is the reason I did not receive both. She recommended a stateside mailing address, which for me I have a mail forwarding service.

Currently the wait time is 6 - 9 months, though it depends upon the individual agent that is handling your I-130 as to how long it will take to process. She said multiple factors affect the processing time, to include: current caseload of the assigned agent, how complicated and thorough your case file is, etc. This would explain why cases are processed out of order.

If you're living in the US I can't really provide you any other additional information as that is not my situation. Best of luck to all on the continued wait.

Hey guys,

I would like to know if anyone's I-130 petition got approved, who filed in March or April ? Its 3+ months that I filed my petition for spouse and there has been no updates after getting NOA1. I want to get an update as to what is going on. They are just quiet.

I called USCIS and they told me that they are still processing the I-130 petitions from Nov 2012 ;( They also told me that the case would be transferred to the local office from NBC. There has been so much confusion regarding case processing in NBC or local office on this forum.

Also, how to connect to Tier 2 rep ? I tried asking a Tier 1 rep. to transfer me to Tier 2 and they shot me down. Any tips for connecting to Tier 2 ?

Thanks

Here is chart of people's approvals http://www.visajourney.com/timeline/monthly_filers.php?form=2&visa=3&scenter=4&option=3&sortby=2

Some approved in March/April though is people that live oversea together..

Files being transferred.. All files when the USC lives in the states are suppose to be transferred to their local office.. I'm thinking maybe the teir 2 just don't want to go through the effort to see if files are being transferred or maybe some are not.. But can get a idea on how many files your local office has by here

http://dashboard.uscis.gov/index.cfm?formtype=4&office=22&charttype=1

To talk to a teir 2... You can be confrontational and persistent to be transfered or you can ask questions that the teir 1 does not have answers about.. For example: teir 1 does not have access to your personal info whereas teir 2 does.. For me I just ask about status of a service request to change my personal info (which they can not see) and then asked if I can be transferred to someone who could actually look at it (teir 2).. I haven't had any problem.. Everyone's method to be transfered is different though

Hope it helps

Finished for now!!

This entire thread is people asking about approvals.. read from the beginning ... It should answer your questions.... or make you more confused.... Most will tell you that waiting 3 months is nothing...( of course to the person who is waiting...its an eternity) Prepare for the worst... so when something good happens, you'll be happy.

Tier 1 can only read the screen you can see when you check your status on the USCIS website. TIer 2 can see more but its like pulling teeth to get it out of them. Its my experience that everytime I call, it seems I am annoying the person on the other end by asking for details about my case..... They sure don't offer much...

There is really only 4 April approvals in Igor's list. I didn't check their situations so I dont' know if they are all out of the country or what. I would think they should be processing March and april.... but then again, nothing they do makes sense..LOL

I have seen an I-130 approval within 165 consecutive numbers previous to mine...I hope this means that we are getting closer....it was MSC1390983725. The goverment needs to overhaul the system. And to me its strange that all the paperwork is never converted to an electric file..so they dont ever get lost between agencies...
