DV, check out the response I received this morning... looks like a new STALL tactic. I was super worried about this until I read your post.

U.S. Citizenship and Immigration Services (USCIS) records confirm that this case is pending background check clearance. USCIS is committed to adjudicating immigration benefits in a timely manner while also ensuring public safety and national security. A small percentage of applications and petitions have unresolved background check issues that temporarily delay adjudication. Although USCIS makes every effort to resolve such cases promptly, USCIS is unable to speculate when the background check will be completed.

If a background check reveals an issue that may impact an applicant’s eligibility for the requested immigration benefit, further inquiry is needed. The inquiry may include an additional interview and/or contact with another agency for updates or more comprehensive information. Upon gathering and assessing all available information, USCIS will adjudicate the application as quickly as possible.

I was worried that they are trying to verify something in Costa rica.... its just that Costa Rica works on "TICO TIME" in american terms, they take their time doing EVERYTHING... soooooo slowwwwww.

The whole thing is most likely copied and pasted so many times a day. Its bs. I'm so pissed! My friend who is a state rep in Texas said I should go higher up in my congressman's office to their district manager or even chief of staff with my story and case. Maybe they would call TSC and kick someones a$$. I know for a fact there is NOTHING in mine or my wife's history that should hold our case up.

DVMan and LovemyTico, you can request from the FBI whether or not your case has been researched or your files asked for. You can also request the FOIA on your cases. If those show that nothing has been done on your case, then you can show your representative that the USCIS is lying and see if they can doing anything about it.

I would respond to my congressperson that the security checks they are suggesting are in process could have well been done within the past (nearly) 10 months that they've had your cases.

I'm so sorry that you guys are still waiting. If you want the info on getting your FBI file/what to request, and your USCIS file/what to request, please let me know and I'll look it up for you both.

Again, I was getting prepared for the chance that our case would go over a year, and wanted to make sure I had all of my ducks in a row, so I was researching what we needed for a writ of mandamus and/or to try to get actual help from our representatives. That Wikipedia article was interesting concerning FBI "Name Checks." Seems like that it is another log jam that causes extended waiting and there has been criticism even from the courts related to the delays it causes us. Yet USCIS argues that it is necessary to the national security and public safety. Whatevs. I submitted an email FOIA request as described by the FBI. Hope i get some info!

I hope that you get a "no file". That means that your "extended" background checks are nothing of the sort. If you've got no file, then there's nothing for them to look into. That is an indication that you have no criminal background. That would mean that you could contact your representative with that information and have them call out the USCIS on your behalf. No idea whether they'd do anything about it, but it's worth a shot. Like I said, I was considering exactly the same thing right at about the point I got my approval.
