Timeline

LoveMyTico and anyone else who filed the I-129f later, just thought I'd give you an ...the government has thrown me a cruve ball! Both my I-130 & I-129f were approved by USCIS and then the I-129f went back into "intial review" at USCIS and tier 2 told me he "had no idea what they were doing with it"...so I just forgot about it.

My I-130 has been received by NVC & I am calling twice a week to check for case #. Today, out of the blue, I received a letter in the mail from NVC saying that they have approved my I-129F and forwarded to the embassy in Mumbai!! WHAT?! I just checked two weeks ago and it was still under intial review at USCIS. But now I'm left in a lurch because I don't know what to do.

K-3 is supposed to be only valid while you have a pending I-130...but my I-130 has already been approved and is awaiting attention at NVC. So I don't even know if my hubby can even APPLY for the K-3 anymore. Which begs the question then, why did NVC approve it in the first place if I cleearly have an I-130 sitting in their office? Even if he did apply and receive the K-3, would my husband then have to immediately Adjust Status upon reaching the US?

So confusing! I wish they would not have been approved at the same time!

I know a lot of you are still waiting and I'm not trying to be insensitive posting this, just giving you a heads up about what might happen if you also filed the I-129f later in the waiting period. Keep thinking postive! :-)

Got an RFE from TSC on Jan 9th. Still waiting for the hard copy. I was transferred to TSC on 11/27

RFE sux but at least I know they are working on transfers from NOV 27th.

ok listen... my past experience with the K3:

once your files get approved, they both go to the NVC. The K3 only stays there to get a case number then gets immediatley sent to the embassy. THe I-130 stays at NVC for the bills to be paid and to get a case complete. Once the K-3 gets to the embassy, the embassy takes over and they sschedule the interview etc.

IMHO, if your K3 actually gets to the embassy... GO FOR IT !! I was just discussing this with someone... For us, we still need to file a waiver so waiting for the I-130 to be complete at the NVC is wasting time. IF my K3 gets forwarded to the CR embassy, We are going with that and we don't care about the extra money to adjust once he gets here. At the interview they will tell us we need a waiver... the same ####### they would tell us if we went with the I130, so for us, it is saving 2 months because the NVC takes forever to process and complete a case. I don't care if he doesn't get his greencard immediately when he gets here. I just want to be with him so adjusting is just fine with us.

If you want to get him here faster, go with the K3. Im actually wishng that happens to us.

You can go with the k-3 as long as you don't pay the bills for the I-130. The I-130 will sit at the NVC for a year .

Yeah, I would file for it now. No guarantees that you won't have to get another one, but when you get your approval, hopefully your certificate will still be good at that point.

We didn't get a police certificate because there was a bunch of outdated information online where it states that the Consulate will get it for us. I contacted them directly to ask about it, and they responded immediately and pointed me in the right direction for my husband to request it. So we did, and now we're waiting to get it from the Dutch Government. That's okay, because we'll probably be waiting a while to get to that point with the NVC.

HAHAHA, your kids got approvals. Were their petitions based on your marriage to their parent? Seriously, as soon as you get that RFE, I'd write an email detailing the situation to the Ombudsman.

Yeah funny right?? I'm confused too.

But when I had check my status num and other two numbers( two kids), they showing review for my num only.

So... Don't know what exactly they want from us. It will be stupid stuff. Hope my hubby get hard copy next Monday.

Btw congrats for your approval!

I'm happy your children are able to see the father soon ;)

We live in Canada while waiting for the green card. We are not in Japan.

I would have applied for the police certificate long ago however the Japanese government does not issue a certificate without an authorization letter from the US Government. We cannot apply for it without approval of the I-130.

Hence why I asked specifically for those with Japanese wives.

Yes you r right.

they said takes few months. If your wife were in japan, it will take only two weeks.

Yes, We have a lawyer. He enclosed extra passport pictures and my husbands Birth cert. So I will be VERY surprised if I get an RFE HOWEVER, now that I just said that.... We all know I'll get one now !!

We were transferred on Nov 27th. Both files Last touch on K-3 Dec 2nd, Last touch on I-130 Dec 3rd. I was told on Dec 30th that my file has been assigned to an officer. I guess that officer is allowed to have files in their pipeline indefinately....

If our K-3 comes through and gets forwarded to the embassy, we're taking it !! This whole processes is taking time away from us that we can never get back.

OMG!!! So I get the third I-797C in the mailbox yesterday and it says that in order to spend up the process my petition has been transferred to USCIS-NBC lee summit, MO...really!

####### are these people doing I'm so freakin pist right now...first they transfer it around the TSC a few times now it's sent back to NBC

definitely going straight to my congressman's office tomorrow morning with all these transfer notices I want some answers

Just spoke to my husband... He said ABSOLUTELY we should go for the K-3. He doesn't care about having to adjust once he gets here. We'll pay double if it shortens this torture.

no I haven't contacted my congressman before...I did talk to a tier 2 operator on Friday who submitted an inquiry to the TSC on friday because of the previous two transfers...but they sent the s@$t from NBC in November supposedly to speed up the process. ..why then are they sending it back in January for the same bulls$!@ reason...

so tired of the inconsistancy of this whole process. It doesn't make sense that they transferred you to TSC and now back again to a sevice center we all waited months to start adjuducating... then We all got transferred.. and now they decide to send "already transferred" files BACK to the NBC??? Please keep us in the loop. I am dying to know the explanation for this one.
