I wouldn't mail it until someone asks for it. With all those files over there... just wait til its on someones desk and if you get an RFE, that person has it right there. If you send it now, it will get lost for sure or never make it there and you'll just have to send it again. You also might get someone who doesnt even care about the BC for the beneficiary. just my opinion.. do what you want... I just think its a ####### shoot . Some people get RFE's for the BC and others don't

You make some good points. Who knows if it will even make it to our file? Definitely leaning towards waiting to hear from them first.

Well, can't send it "right away" as my wife is still here in the US. She has her birth certificate in Germany in her (go to the embassy" stack of paperwork. So have to wait for her to get back. Then she needs to make the copy, and I'm still deciding if we should pay for a translator or take our chances with my wife translating, as she probably speaks better english than me. lol Perhaps I will try mt congresswoman as well. and fax it directly to her office with a copy of the I-130 instructions.

Knowing Texas, they have anybody with congressional support in a lost box.

If I were you I would just pay to have it translated. Just in case because you don't want another rfe and hold up you case even longer, which they could do if they don't think it's official. Just my thoughts . Good luck to you!

A friend of mine told me about some country roads in Canada leading right into the US with barely a few homes and no one at the border - those roads are simply widely open; but people don't know about them because most use major high-ways for travel.

I am at 9 months 3 days and nothing yet. If I knew this process was going to take this long and knowing the info about the widely open roads between Canada and the US; I would have asked my wife to go through Canada and enter here illegally like most.

USCIS current process for legal immigration is affirming that illegal immigration is the way to go. Sad that we are being punished for doing the right thing.

So I received an email today from my congressman's office in response to their last inquiry...here it is:

Thank you for your Wednesday, December 18, 2013, email on behalf of your constituent, #####, regarding his pending Form I-130, Petition for Alien Relative, he filed on behalf of #####.

U.S. Citizenship and Immigration Services (USCIS) records confirm that Mr. #### case is pending background check clearance. USCIS is committed to adjudicating immigration benefits in a timely manner while also ensuring public safety and national security. A small percentage of applications and petitions have unresolved background check issues that temporarily delay adjudication. Although USCIS makes every effort to resolve such cases promptly, USCIS is unable to speculate when the background check will be completed.

If a background check reveals an issue that may impact an applicant’s eligibility for the requested immigration benefit, further inquiry is needed. The inquiry may include an additional interview and/or contact with another agency for updates or more comprehensive information. Upon gathering and assessing all available information, USCIS will adjudicate the application as quickly as possible.

USCIS realizes that Mr. #### may be frustrated by the progress of his case. However, the agency must balance individual inconvenience against broader issues of public safety and national security.

I know for a fact a background check can be done in a few minutes for US Citizens...sooooo they must be trying to check my wife, if in fact they are being honest and not just delaying. The Congressman's representative called TSC and they told her that my case is under review with an officer and it should conclude within two weeks. Notice the date USCIS was emailed and they just now responded? BS! Anyway, I will start getting my next round of paperwork ready just in case we get approved. Anyone seen an accurate listing of how long NVC stage is taking? This is a good sign that I should be approved soon, I am just so fed up with them, that I haven't gotten excited today yet. Maybe tomorrow.

lol, you are correct - a TON of roads where its just Canada on one side and USA on the other. Its pretty funny, and there really are not many issues with people just jumping over. I have thought that when I officially move to the US I should just drop my cat off on the road and then call him once I get to the US road, can't ban a cat, can you?!?! lol

I don't believe the backgorund check malarkey. That was done months ago... I was also told my case was assigned to an officer last Monday. Whatever that means... And does being assigned and under review mean the same thing? I haven't gotten excited either because I know its all ####### just to hold me off from calling again... Where is your file? TSC? in the same box as mine?

For all those going for their interviews, petitioners be sure to send a copy of the affidavit of support (AOS) to your spouse to carry along to the interview. I have seen a lot of people where the consulate requested AOS even though it had been submitted at the NVC. Be sure to take all necessary measures to avoid any further delay on your case.

Why would NVC keep collecting the $88.00 AOS fee if the consulate abroad turns around and ask for it again. AOS are supposed to be processed at the NVC stage and forwarded abroad.

Someone from May (05/23/2013) got approved at TSC yesterday. How can this be when a bunch of March and April filers are still waiting?
