So, I received the hard copy of my RFE: It took 9 months for USCIS to tell me I need a copy of my wifes birth certificate. NO WHERE in the I-130 instructions does it says that that must be submitted for your wife!!! My wife finishes her vacation here next Sunday, in which she will go back make her copy, translate it and send it to me to fedex off to them. My congressman will here about this!!!!

Definitely agreed, Texas seems to be the main (only?) culprit behind the beneficiary birth certificate RFE. So sorry this happened to you. I'd be writing to the service center directly as well, quoting I-130 instructions, the whole nine yards. I don't understand why this service center is continually disregarding USCIS' specifications for the I-130 packet.

Glad we included my husband birth cert with our package. Now if I could just get them to approve us.... Does anyone have any idea what " assigned to an officer" actually means? and how long does it take for someone to pick my file up and look at it and approve it after ebing assigned? I could be assigned to the same officer for a month. Maybe each officer gets a batch of 500 assigned to them. WHO FRIGGIN KNOWS????? UGHHHH

Well, can't send it "right away" as my wife is still here in the US. She has her birth certificate in Germany in her (go to the embassy" stack of paperwork. So have to wait for her to get back. Then she needs to make the copy, and I'm still deciding if we should pay for a translator or take our chances with my wife translating, as she probably speaks better english than me. lol Perhaps I will try mt congresswoman as well. and fax it directly to her office with a copy of the I-130 instructions.

Knowing Texas, they have anybody with congressional support in a lost box. :(

That's horrible. We're likely going to go through the same thing. Our case was transferred to TSC as well and we did not include the beneficiary birth certificate. As you mentioned, it wasn't listed in the instructions. I'm wondering if we should just mail it in now before they issue the RFE. Will likely save us some time.

I wouldn't mail it until someone asks for it. With all those files over there... just wait til its on someones desk and if you get an RFE, that person has it right there. If you send it now, it will get lost for sure or never make it there and you'll just have to send it again. You also might get someone who doesnt even care about the BC for the beneficiary. just my opinion.. do what you want... I just think its a ####### shoot . Some people get RFE's for the BC and others don't
