How come few years ago USICS was approving I130's in like couple of months. Why does it take them so long now, and ok i can understand 6-8 months, but what the hell are they talking about 16 months etc.?

Is there a REASON why this long ?

I think your only looking at part of the Life Act. I've read the whole thing.

The temporay part of the Life act was a V visa. That got USCIS out of the hole then. V1 and V3 were like K1-K2 or K3-K4's are now. They had a time limit and are no longer used. The K3 is still on the books.

Other things I've found:

For a long time people filed I-129f and the I-130 on the same day. Then USCIS said that they would no longer accept them together. Then People filed for the I-129F as soon as they recived the NOA1 for the I-130. So then the USCIS started saying we will now join them together.

At the last AILA meeting (6 months ago) USCIS said the I-130 are progressing so fast (under 6 months) we dont need to un-join the K3 at this time.

At some other AILA conference (That we heard so much about 3 weeks ago) there was more talk between the Lawyers about the need to or not to still file for K3's as the I-130 would now start to pick up speed from October filers on. To see this you need to read all the text messages back an forth between the Lawyers. Everyone got hung up on the standing in line thing and did not read and understand what the other lawyers were saying.

So i think the USCIS really does not like the K3. Why would they want 20-30k new app.s comming in to process that they get zero funds to handle. But I also think it is a govenor for a slow down for the IR1-CR's. Why would Congress make it free to file for a K3 unless they really wanted it to be an easy option.

This is what I think, anyone else can look up the same things if you have the time.

I tried reading those transcript text things, but i could not follow. But in reference to picking up speed from "October filers on"...does that mean October 2012 or October 2013??

And if its Oct. 2013...then that information really does no good for those of us having filed BEFORE then and still currently waiting.

I just want a solid, legal answer from someone who has solid information about whether or not its worth it for those of us who have already been waiting 6 months to file for the K-3? I mean, are we seriously looking at potentially another 5-6 month wait?! That right there seems like awfully good grounds for unjoining the I-129fs & I-130s.

But if we ARE talking about October 2013 filers, how in the world are their applications going to be approved quicker if they still haven't gotten through the backlog of applications that are our files?

If we AREN'T talking about October 2013 filers but rather October 2012...then please ignore the rant! ;-)

Feeling very very frustrated at this process. Its so painful to have dreams about the future, but not know if they're ever going to get a chance to come true.

I agree with you 100% and I am glad you said it !! "criminals" HOW THE FRIG do you reward a criminal with a pathway to citizenship or priority processing when the citizens who followed the law BY THE BOOK get thrown aside?????.. And in my opinion, everyone on this forum should be against amnesty.... I don't care how long they are in the US ILLEGALLY... go back to your country and file your papers just like the rest of us had to do... You knew the consequesnces when you crossed that border undocumented.. now deal with it. I am appauled that the government is delaying the I-130's filed the correct and legal way ... I am sure I'll get my comment deleted.... oh friggin well

HI everyone. I just wanted to post here to let everyone know to not loose hope. I am an April filer. I recieved my NOA1 April 1st. and Just recieved my NOA2 yesterday with an approval notice. my case was a normal case and was not expedited at all. time between NOA1 and NOA2 was 205 days The only thing I recommend you do is to regualrly schedule an infopass appointment at your local office. keep hammering them to look at your case, hopefully getting it into the hands of an adjucator. Stay postive, all of you will hear something very soon. smile.png

I and my wife are in the middle of changing apartments and I need to wait to get paid again to file. When I file next week, I will update it.

October 2013, this happen 3 week ago.

The point they were making was that from then on it would not matter because they think the next group of filers will get in a shorter line.

I took it as by the time the 0ctober filers are due (in 5 Months) the filers from before will have been finished. So 11-12 months for the Febuary filers, less for the March and april and so on until the USCIS hits thier Goal of 5 months.

Then I was reading that USCIS may have changed thier mind again a few days ago.

I hope we get some solid Legal answers too.

The USCIS portion of the K1/CR1 is the same.. The additional time for the CR-1 is the USCIS-> NVC stage which normally adds about six weeks (The paperwork gets done at this stage for the CR-1 whereas the K-1 does this step after the person arrives in the states) . CR-1 is less expensive overall and does not have that additional round of paperwork after you get married or the requirement to get married 90 days after entering the country.

K-1 advantage: You will get them here six to eight weeks sooner.

CR-1 advantage: Less cost, no time constraints when they arrive, no extra round of paperwork when they arrive. CR-1s get approved at a higher rate (though for Colombia this is not really relevant), they get the GC, SSN, and the ability to work soon after they arrive.

You would have to add back in the time it actually takes to get married as you can't file the CR-1 until you are married. The K-1 could be filed today today.. One advantage there getting married in Colombia will likely be cheaper and allow his/her family to attend.

If you are already married the K-1 is no longer an option.

One disadvantage for the CR-1 in Colombia: Getting married as a foreigner there is a bit of a hassle compared to the states...

How can you tell people this BS. Listening to people like you is what got me into this nightmare. All anyone has to do is vist the Febuary thru September I-130 Filers threads and you can see for yourself. So dont put out your standard line BS to people. USCIS turn around for a CR1-IR1 could be 12-16 months. K1 are 3-4 months then you wait for NVC 2-6 months.

Hmmm good question, probably they don't like citizens any more . that's why they approve K1 in 15 days and never approve K3 , and ask for 16.6 months time for i130 noa2.!!

Hoping mine doesn't get transferred TBH...the Newark office is a hellhole. On the other hand if it does, my family knows some NJ politicians so maybe I could get mine pushed...

Honestly I just want this part of the process over with either way.

Also I talked to a US customs officer when I came back to the US a few days ago--he told me my husband could visit me while the I-130 was still pending, no problem. Though he did specifically say only if he is a Canadian citizen.

I filed my I-130 on June 3. My PD is June 10, 2013. Its been long and rough journey for me because I'm so far away from my wife. She starting to lose hope because of this long process upon us. I'm reading on others forum and I stumble with this idea that people who file I-130 also applying for I-129F. They said its free since they filed I-130 petition, and you need to pay $1050 to adjust ur status in case it get appove.



My question is..


1. is this true? i can file I-129F together with my I-130 to get approved faster?


2. this will not affect my I-130? because if not, i dont mind paying that much as long it will get approve fast. I just really want to be with my wife so i dont mind spending. crying.gif
