Timeline

Did the approval come from MSC or Overland Park?

I haven't gotten the hard copy yet, so I don't know the answer to that. I can tell you that the text and email just said it was from USCIS. I also, have no idea if it went to my local office or not. My NOA1 was MSC from Lee's Summitt, MO. I wasn't expecting to hear anything yet and was waiting for the 6 month mark to hit before I started making calls and trying to figure out where my case was (I really wasn't wanting to have to deal with the misinformation line). Sorry I don't have more info. When I get the hard copy if there is more detail I will definitely share.

To be very honest, I wasn't expecting to make this post for at least another month....but I just got a text message from USCIS saying "On September 30, 2013 we mailed you a notice that we have approved this I-130"....blah, blah blah...I didn't even read the rest. dancin5hr.gif I'm still in shock. The only bad thing....my hubby's phone is turned off or out of battery.....I can't wait to tell him. I'm so happy right now!

I know I'm late to this party, but CONGRATULATIONS!!!!

Just spoke with tier 2 rep and they said 6-9 months and I can see something from the middle of this month to January. No pacific time on when I will receive something.

I just called USCIS and tier1 did not want to transfer my call to a tier2. rofl.gif I won't call them again It's a waste of time, they tell the same thing over and over WAIT for them to contact me oops8rh.gif I wish we could filed for K1.cray5ol.gif

Im officially 6 months into noa2 wait. Hope to hear something by Nov 1. I have not called USCIS ever and dont plan on it as they tell everyone the same generic info.

I just noticed on my timeline expected abjudication date has been shortened from Oct 22 and is now Oct 20 as expected abjudication. Usually it keeps getting delayed.

A very nice woman from the AILA responded to me, and while she couldn't tell me anything about Overland Park's current status, she did say this:

"I was with the group that went to the NBC last May and we also visited the Overland Park facility...The two facilities are only about 30 minutes from each other so I am quite sure that I-130s filed at Lee’s Summit will be shuttled over to Overland Park."

Just another piece of the puzzle. She very kindly invited me to follow up with her for more information after the October 31 AILA meeting with the NBC, and I will definitely be doing so.

Wow, you have a contact with a Nice Woman at AILA. There is something I would like to have asked again at the next AILA/NBC meeting. This is a question asked at the last meeting:

With the passage of the LIFE Act in December 2000 and the promulgation of implementing regulations in April 2001, both Congress and Legacy INS announced a policy that would, in theory, allow foreign spouses to join their U.S. citizen spouses in the United States quickly and avoid the long separation associated with increased I-130 processing times. USCIS has adopted a policy to adjudicate the K-3 petition (Form I-129F) and petition for alien relative (Form I-130) simultaneously. This practice effectively eliminates the benefits of the K-3 petition and frustrates the intent of the LIFE Act together. DOS takes the position that when the I-129F and the I-130 are approved together, the beneficiary becomes ineligible for a K-3 visa and therefore, proceeds with processing the immigrant visa application. Will USCIS reconsider its policy to adjudicate both petitions together and implement a policy to adjudicate K-3 petitions within 30 days in order to achieve the clear policy imperative announced by Congress with the creation of the K-3 visa?

Response

The K-3 visa was intended to reunite families separated due to a backlog in I-130 adjudications. However, I-130s are no longer backlogged and are currently being processed in under 6 months. Therefore, USCIS does not, at this time plan to implement a new policy on the K-3 visa petition process.

I case you dont know it was set up to get your spouse with you in 3-4 months (including the NVC time).

Helly everyone! I'm new to this site here reading a lot of different things and hoping for some possible answers from fellow members on here :)

I'm an April 2013 I-130 filer with the NBC. I hired a lawyer because I was nervous I might make a mistake and than delay the petition, but he's fairly useless at ever directly answering my questions (I understand he's busy, but still extremely frustrating). I received the physical receipt notice late, in June, because the wrong mailing address was placed on my petition for some reason (so much for no mistakes). I had been monitoring the case on line after asking my lawyer for the receipt number and noticed a change on June 6 stating they had mailed me a document the document was the I-797C and on the bottom of the page there was a stamp and handwriting stating that my case had been approved for filing 6/6/13, but the priority date is printed 4/16/2013 at the top of the page. Wondering if this is normal or if anyone might know anything about this?

Also, wondering if anyone might be able to provide me with suggestions of what I could be doing right now while waiting for the NOA2, which is excruciating! So hard being away from my husband who I just got back from visiting after seven months of being apart. I tried to put off my vacation thinking we might have heard something by now. Even more frustrating seeing others petitions from earlier on being processed much quicker so I'm nervous something might have actually been done wrong? I haven't sent in my affidavit of support yet because I was told it would be requested. Any insight or suggestions at all would be extremely appreciated!
