Ok the offical RFE today read as fallows. "If you are a k-1 fiance who had a medical exam within the last year as required for the visa, submit a vaccination supplement"

My questions on this

1. Since they have had this application for over 9 months now, technically our medical exam is now over one year old. Do we need to redo the whole exam?

2. We supplied the DS-3025 vaccination worksheet to them, i suppose this is not sufficiant?

3. Do we have to just go to a doctor and have them fill out page 1 and 5 of the I-693 and mail that portion to them?

What would you guys do in this situation?

What does the whole RFE say? You are not a K-1 applicant who had a medical in the past year - it's been longer than that. Though I assume you initially applied within a year of the exam, hence why I am wondering what the whole RFE says.

I am thinking a I-693 vaccination transcription is required, but there seems a few things to check first.

We had our medical exam on February 22 2012. Were received the NOA for the AOS on July 12th 2012. We received the RFE April 8th 2013. So as of now we are over the one year timefram due to immigration sitting on the application for 9 months.

Right, but my guess is that they will count when you submitted the app, but I am not sure. AOS used to take years and I don't think people had to get a new medical.

Hopefully people who know for sure will chime in.

In the meantime, you can look in the "Civil Surgeons who don't rip you off" thread to find someone near you that will do the vaccination transcription only.

Can you post exactly what the RFE wording was?

Also do you know for sure your DS-3025 was actually complete and filled out properly? If it wasn't, then no they couldn't use it.

I like how this application was at the NBC for 9 months and now they are requesting for initial evidence. It says it must be receieved within 87 days of this notice.

Yes I did and I can tell you if you did your exam in Bogota where we did it, it probably has the same issues. I bet it has something to do with the bottom of the page where the Dr. checked the box incomplete.I think we are going to redo the whole exam and send everything. Dont want another RFE to come, waited long enough.

Here's where it gets tricky! Some people have submitted a DS-3025 (obtained overseas at your medical documenting your vaccinations) with their AOS package and have NOT received RFE's. Some HAVE. If you want to be absolutely safe in terms of your medical documentation as a K-1 adjusting status, you should take your DS-3025 to a USCIS-certified civil surgeon and ask them to transfer the information from your DS-3025 to an I-693. They should do this for a nominal charge. If they try to tell you you need a full medical examination, DO NOT LISTEN. You ONLY need the vaccination part. The following memo from the USCIS documents that this completed form will remain valid beyond one year when submitted with most Adjustment of Status applications.

The civil surgeon should give you an I-693 documenting the fact that your vaccinations are complete (either they were completed when you had your medical or you had them completed stateside). You should submit this with your AOS package.

Purpose of Form :

Generally, all applicants filing for adjustment of status to that of a lawful permanent resident must submit Form I-693 completed by a designated civil surgeon. Form I-693 is used to report results of a medical examination to USCIS. The examination is required to establish that an applicant is not inadmissible to the United States on public health grounds.

So looks like yes, we all have to do an I-693 with the AOS

I plan to call first thing Monday and get an appointment to get the I-693, Report of Medical Examination and Vaccination Record and send it as fast as possible to the Chicago box. According to USCIS website, the paperwork must be sealed by the doctor.

Where to File :After completion of the medical examination, the civil surgeon is required to give you, the applicant, the completed Form I-693 in a sealed envelope. Do not accept it if it is not in a sealed envelope. USCIS will return the form to you if it is not in a sealed envelope or if the envelope has been opened or altered.

It is the applicant’s responsibility to submit the Form I-693 to USCIS, not the civil surgeon’s.

If you are applying for adjustment of status: Submit Form I-693 with your Form I-485, Application to Register for Permanent Residence or Adjust Status, as detailed in the Form I-485 instructions.

Other applicants: Follow the instructions on or included with the application or the instructions given to you by the office requesting the medical examination.

Now I am totally confused because, she did get an exam in Bogota? All should had been included in the sealed envelope?

Also at USCIS: For abroad: "The immigration medical exam must be conducted by a physician designated by the U.S. Department of State (also known as a "panel physician"). See the Department of State website to find an approved doctor near you."

Speaking with them "NBC" is useless as usual, they cannot tell me if they have the form, they lost the form, the form is filled out incorrect or not. They told me to submit exactly what I submitted the first time. She also told me this " if it was me I would redo the whole exam to be sure you will not receive another RFE".

Spoke with many civil surgeons in my area they are all happy to redo the whole exam and I also found some that will just do the vaccination supplement.

We decided to take teh expensive path and redo the whole exam. Went to an appointment today and redid the medical. Will pick up the new sealed package Monday and ship it out Monday afternoon. They should have the package back in their hands Tuesday.

Due to our situation we need this green card as quick as possible and redid the exam to be assure no more issues.

This process is a big racket and the people who do the system correctly are the ones who pay "everyone in this process".

I think you made the right decision because you have waited a ridiculously long time for the greencard. No point in guessing what they have and if the expired exam would even be accepted, which is the bigger issue over if the DS-3025 was filled out properly.

Edit: I am really curious about your DS-3025. Could you scan it and mark out the names and post it somewhere.
