I would like some clarification on the 129F process for Fiancé with minor.

She is a Chinese citizen living in Canada. She obtained her Canadian Perm Resident through a past marriage. She has a 4 yr old child. The divorce paper states "Custody right of legitimate son xxx belongs to the female party" with the dad having visitation rights. To me the wording doesn’t clearly express that she has sole custody.

I would like to know if she were to list her kid on the i129F application and want to bring her kid with her what kind of documents would she need from the dad. If this is needed, when would she need to submit it as part of the K-1 process?

According to my research, it said something about if a single parents is traveling with the kid a notarized note from the other parent is necessary. Last time when she left Canada with her kid, she was never asked for anything from the customs agents.

Just to clarify, the 129f form states for her to list ALL her children, regardless of age or immigration intent.

When you fill out the DS-156K form for the interview, is when you list which of those children listed are desiring a K-2 visa.

So you have until then to decide.

That's maybe for Canada. Typically for US visa issuance a notarized letter from the other parent granting permission to permanent immigrate to the US is required....and permission to visit to the home country and re-return to the US.
